Neighbours Chimney Damage Causing Damp.

With respect, having looked at the photos at best you may be able to claim it is accidental damage to your contents but the external repairs appear to be wear and tear.
I note you have had previous problems so even AD would be a stretch!
If the chimney is your neighbours (only) then they would be responsible to maintain it and prevent further ingress.0 -
Hi. I have added a few more pictures. Including ones from the front of the property.. As I can't get any clarification. I looks as if the chimney stack is on both properties.
So do I have to take some responsibility for the leak. Keeping in mind we have no chimney breasts on that side of our building. It's a stair way to the second floor.0 -
To be honest, you are better off asking outside of the insurance forum and on the more general Home section as this is really a question about party walls.
I think you are better off biting the bullet and just dealing with the matter with your neighbour.
Just remember that as you informed your insurers about the incident and they declined the claim that you will have to declare this for the next 3-5 years when getting new quotes0
