PPI Aronold Clark

Options
Hello,

I believe i have been miss sold PPI from Arnold Clark in April 2009.

I have approached them and have been sent a PPI consumer questionnaire.

I was wondering did anyone else have any luck claiming the PPI back from Arnold Clark?

According to the FOS stats they had 305 complaints referred to them between 1st Jan and 30th June 2013. The last published complaints upheld rate by the FOS against them was a very low 5%. (i.e. 95% of complaints to the FOS with Arnold Clark lost).

However, as each case is looked at on its own merits, the chances of you suffering the same issues and speaking with the same staff member in 2009 is unlikely. You need to look at what your reasons are. Given the very low success rate at the FOS, this either indicates they have a strong audit trail and can justify their sales or that they handle complaints fairly when they are made and the FOS do not need to overturn many decisions.

Thanks for the update. I belive I have a good reason i was buying the car to take on a new job which was only a 9 month contract.

Also I was young and stupid at the time i was informed by the sales man taking PPI would improve my chances of getting credit as I was taking on a temp contract. I made this very clear to the sales man at the time.

To tell you the truth this is been playing on my mind for a few years since i started hearing about mis-sold PPI on the news. I thought it was time to aleast do something.

I posted off the form today to Aronld Clark so we will see what happens. Hearing about the FOS only winning 9% of cases I dont hold out much hope.

    Thanks again.

It seems odd that an application for a loan would be successful if that information was disclosed on it - so it appears likely that the documentation would show a different story.

If so, the firm would be able to say "that is not what you told us at the time".

Perhaps - but that is not the fault of the dealer.

That would be a valid reason - but you need evidence to support your assertion.

FOS neither wins nor loses cases - it adjudicates, but if there is no evidence to support an assertion it is unlikely to find in favour of the complainant.

I bet that ended up being an auto payout. The FOS give firms a chance to settle the case without incurring the £550 FOS fee. So, they had a choice to pay you £371.83 or pay the FOS £550 (possibly £850 based on cases referred to them) and then run the risk of losing the case. Common sense says that paying you £371.83 is the least expensive option.

Yes, I thought that when I saw the redress amount too.
