New Parking Charge - UKPC

First things first, I've read the stickied advice up at the top and just wanted to say a thank you for all the advice on here :beer:

I've recently moved home. I've just returned from my old house to collect letters and found one from UK Parking Control dated 18/12/13 asking for £100. Knowing i should not ignore this, i'm going to go through the process of soft appealing first.

Now, i'm fairly certain the signs state parking of no longer than 2 hours. The pictures on my letter show me driving in and out of the car park, and that i stayed 00:08 over the 2 hour limit. Do i have a strong case of stating the driver was looking for a space for 00:08 and that the parked time was actually under 02:00?

Also, i can challenge via email - would this be an ok way to do it or is challenging via letter better?

  • If an email appeals route is specified on the ticket, then use it, but keep screen copies of the appeal you submit and any confirmation page that comes up. If you choose to post it, get a free certificate of posting from the post office. Do not use recorded delivery.

    As well as all the usual appeal points, yes, you must include a point that insufficient "grace period" has been allowed as stipulated in section 13 of the the BPA Ltd AOS Code of Practice. Your appeal must therefore be allowed on that point alone, let alone any of the others.

    And complain to the BPA Ltd that UKPC are breaching the Code of Practice and therefore operating unlawfully (in breach of CPUTR).

    Dear UKPC,

    As the registered keeper of (reg) I'm in receipt of your parking invoice xxxxxx dated xxxxxx. I wish to invoke your appeals process as all liability to your company is denied on the following:

    1) The amount being claimed is not a genuine pre-estimate of loss to your company or the landowner
    2) Your signage does not comply with the BPA Code of Practice
    3) You are not the landowner and do not have the capacity to offer contracts or to bring a claim for trespass

    These points and others will be raised with Popla should you not accept this appeal, and you will be expected to provide a full breakdown of your alleged loss, and your full unredacted contract with the landowner.

    If you do reject the challenge and insist upon taking the matter further I must inform you that I may claim my expenses from you. The expenses I may claim are not exhaustive but may include the cost of stamps, envelopes, travel expenses, legal fees, etc. By continuing to pursue me you agree to pay these costs when I prevail.

    Please issue your cancellation within 35 days of this letter, or forward a popla verification code.

    just add that extra challenge into it, but not who was driving or by implication

    so The driver was looking for a space to park blah blah etc , as in the previous post

    UKPC have an online appeal form, so i'm just using that - though as advised, i'll take a few screenshots.

    Redx, i've pretty much used the template you've added. I've only amended point 2: (as well as personal details ofc).

    Does that read ok? I'm not missing anything important am i before i click that submit button?

    as long as you havent removed anything its good to go

    so seems ok to me

    it will either get the charge cancelled, or provide a popla code

    anything else means they are stalling

    I've just tried submitting, but i'm told i can only have a max of 1000 characters. I guess i'll go with the letter method to avoid removing any important parts.

    From memory UKPC allow you to attach PDF and similar documents to the appeal email so long as they do not exceed a certain size. A normal letter saved as a PDF would not come anywhere near the size limit. Then just attach the appeal letter to the online appeal procedure email. I have done this without any problems. It saves posting and you can retain a copy of the attachment and you'll also get an acknowledgement of the "appeal" submission cake to your email address provided but also screen shot what you send.
