Redundancy Payment

Hi Guys,

First time poster, but long time lurker! I need your help and advice....

I was made redundant from comapany X early in January 2013, and for a whole host of reasons, have only just returned my uniform which I was assured that once I had returned I would be paid my one weeks notice.

Now that I have actually dealt with the uniform and returned, and asked for the outstanding monies owed I have been told that I actually owe them money! Within my contract it states that should I leave their employment I would be liable to pay for the uniform, and within 12 months liable to pay for training costs.

Now as I was made redundant, and was ready and willing to work up to the day I received the letter, surely they don't have a leg to stand-on? Does the phrase "you" imply an action on my behalf?

My question who is right and who is wrong? Is their any statuory law that is in my corner or previous cases?

    It's taken you 12 months to return your uniform and you expect them to give you money. Your employment contract ended when you were made redundant. You would have been given all monies owed and your P45. You don't have a leg to stand on now.

    Your original post stated the above. It says you are expected to pay for the uniform, not return it.


    If you are expected to pay for the uniform and the cost of training, then that possibly exceeds the amount due for a weeks notice.


    If you want to pursue the matter, ask them for a breakdown of the amount they believe you owe them. Seems strange they haven't chased you for money in the 12 months if it was that important to them.
