    Unless you told the other person you recorded the call it can not be used against him in any way, even the judge would disregard it.

    I'm not so sure about that. I believe Judges have legal powers to be able to accept such recordings.

    But other than that you are right - the recording cannot be used except for personal use; a transcript however ... ;)

    If this case did ever get to court and the OP asked the car seller to allow the recording to be listened to and they refused, the judge could still take this into account.

    As civil court only relies on balance of probabilities and not purely on evidence, the very fact that permission for the recording to be listened to was refused could lead the judge to think that the seller was trying to hide something.

    I will ask them to replace the panel as agreed. If they dont I will inform them that I have the recording and ask them again.

    Can I just clarify one thing.... I should not play the recording to anyone else other than the sales person who was recorded, not even the service manager who i will see tomorrow?

    But.... i can take a transcript of the conversation with me tomorrow?

    You can't legally play the recording to anyone but the parties to the recording. (You and the sales person in this case).

    You can't legally play it to the service manager. But you CAN tell him you have a recording, and can also show him a transcript. (Make it truthful - don't omit anything, even if it doesn't show YOU in a particularly good light. I'm not saying it does or will, but you know what I mean).

    I've just written out the transcript, including every urr and umm, left nothing out. It was actually quite a pleasent and open conversation so I'm hoping I'm just being paranoid and everything will go OK tomorrow.

    Final questions...
    Can I name the salesperson in the transcript?

    Should the service manager request to keep a copy should I let him or not?

  • Well after all that they have ordered the part and are replacing. I haven't got a date yet but I'm hoping this will be sorted soon.
