    Nonsense, the OP transferred the money of his own freewill, there is no reason why the bank would reverse the transaction.

    i am not saying the bank is responsible if he goes to the bank with his mom and dad and proves it his benefit money they have to give it to him, but the debt will still be on his dads account

    i know quite a few people who owe money and are in debt but if they say it is their benefit and can prove it the bank will give him the money, his dad will have to pay the money back or he will het charges added and after a time will get letters stating if he doesn't pay his account will be closed

    No they don;t it was benefit money when in the mother account but ceased to benefit money (just money) when transferred to his fathers account

    Sorry, you really do not know what you are talking about. The relevant law has already been quoted and applies to legal charges, not bank charges or other outgoings. Some banks may postpone or cancel charges as a goodwill gesture, but they are not obliged to do so.

    Benefit money is not sacrosanct. It is just money.

    There is nothing to prevent banks applying it to charges.

    What the law forbids is "appropriation", which used to be a bit like the "child benefit book" (in the days when it was drawn in cash) being given to a loan shark as security.

    If banks have refunded when presented with this argument, they have done so in error.

    i get my benefit payed into my mams account coz there was problems with mine and coz she dont use hers she allows this and i transfer every two weeks to my dads so i can take it from there coz she dont have a pin number and lloyds have honoured a payment from my dads account of nearly £300 and with out me knowing the bank has taking MY money!!!!!!!!!!!

    You are transferring money from your mother's account?

    I am not sure that her bank would be happy about your using her account as though it were your own.

    A manual transfer was done into your father's account? Then legally the money becomes his?

    I cannot imagine that your father's bank would discuss his account with you without his authorisation.

    Your parents might find that the banks will simply close their accounts for misuse after this debacle?

    The situation is entirely of your/your parents' making?

    Morally your father should repay you the money but I cannot see that he would have any legal obligation to do this?

    You had better try for a basic bank account asap?

    Has your dad contacted the company about the money they shouldn't have taken?

    If they refund that then he can pay you.
