Received damaged Goods. Currys refusing to replace item. HELP!!

Remember, SoGA gives you a reasonable time to inspect the goods to see if they conform to contract. Given they were changing the SoGA so you would have a minimum of 30 days to reject any item for a full refund....4 weeks is definitely not unreasonable imo.
Especially given that's whats a reasonable time takes into account circumstances. The circumstances being delivery men installed it unsupervised and OP only discovered it under the circumstances they described in OP.0 -
but as it is I can't blame them for putting it down to customer damage.
Currys haven't put anything down to customer damage.as they state that I should have informed them of the damage within 48 hours of receiving it, but they do not dispute that the item was received in a damaged state
and I doubt if they would have offered a 10% refund if they thought that the OP had damaged the appliance themselves.0 -

yeah i'm beginning to wonder. i'll collate all of my rights and take it back to them. sounds like there are a few legal angles to approach it from. i've seen a similar situation on a different forum, which occurred recently, also with currys, where the customer haggled up to 20%. i just can't stomach the way they assume they can treat customers like this. they preach my duty regarding reporting the problem within 48 hours yet they haven't fulfilled their duty regarding delivering a brand new item despite happily walking off with my £550. i'd rather have a choice about whether or not i shop from the damaged goods section of the shop.0 -
and what's the point of the soga if they feel they can amend it when apparently they can't? is that why they always put "this doesn't affect your statutory rights"? i guess it doesn't work as it should do as some dishonest folk have previously taken the p##s and now everyone else suffers. thanks for the replies.0
