Help!
I had a repayment plan with a Bailiff Company which I paid off in November 2013. I have now had threatening letters through my door demanding another £440 which they say is in addition and was caused by extra charges incurred?? I asked for a detailed statement which they have sent but it just shows this extra money I am supposed to owe but no explanation as to why? They have told me I have no time to dispute this extra money and will get a van and enter my house.
I have a son at home suffering with Cancer and undergoing Chemo at the moment, he has lost his hair, in a wheelchair and receiving Physiotherapy. I have told the Bailiff this as its causing so much distress to us but they dont care and if I dont pay them they are entering my property without delay.
Surely I have rights to dispute charges I know nothing about?
Any advice would be great
Thanks

Absolutely you do.
What was the original debt for (e.g.unpaid CCJ, court fine, council tax, PCN etc)?
Have they already been in your property in the past? did they levy on your good and did you sign something (a walking possession order)?
This might be a useful website for you to look at - http://bailiffadviceonline.co.uk/
and this section in particular http://bailiffadviceonline.co.uk/bailiff-advice/bailiffs-feesA smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0 -
I did sign a walking possession order back two years ago, but I have made all the payments, the bailiff even agreed in August that my account would be cleared by November, but these are completely new charges that I know nothing about??0

Hello there,
Would you be able to tell us what type of debt this is for - we will then be able to let you know what can be done to challenge the fees.
best wishes,

it would also help if we knew what bailiff firm it is
do you still have the notice of seizure listing the goods and fees charged if yes please post details
your family is venerable and you should not be threatened with removal of goods
have you told the creditor and the bailiff firm about your son

The original liability was for council tax, these new charges are bailiff charges? That's all the detail they will give. I've asked for a complete statement showing my payments but they will only give me a statement showing these new charges?
I've moved my son out as this one bailiff was banging on the window, my son is in a wheelchair and was petrified and he's afraid to be in the house.
The company is B&S bailiff, Blackwood, Gwent0 -
ok time for a formal complaint to the CEO of you council
what council is this ?
do you have the original notice of seizure listing the goods and fees charged
if not do you know the liability order amount and how much you paid B&S
how many liability order do they have ?
when did you get the letter asking for another £440
did you ask for an account statement in writing
did you inform B&S in writing about your sons illness?

I moved my son out on 7th Jan, he was so distressed, he feels better now hes with my parents.
The first I knew about this £440 was the 19th Dec when the letter was pushed through my door giving me until 6pm that day to pay, that's when I text him to query them, and asked for a breakdown of these 'charges' then he put another letter through on 27th Dec saying I had ignored him and he was bringing a van to collect my goods. I then proved to the office that I had not ignored him woth the text and asked if they could send a statement through the post because of the fright it was causing by this man coming to the house but he turned up again with a piece of paper with these charges listed down but no explanation and I was told I had not more time to query them.
It is the same bailiff throughout these last few weeks, he wont give me a name but I have his mobile number and he was the one who banged the windows.
I am also staying with my family at the moment, they know I am a single mum who also has a 13 year old daughter so its a horrendous time.0 -
right all I need is the council you are with and your sons age as you don't have his name give me his phone number (send it by PM) can you also tell me what charges he has written down on this piece of paper he left you
It would help if you still had a copy of the notice of seizure listing the goods and fees charged at that time and how much you have paid if you haven't don't worry about it we can get this from the council the priority is getting this back with the council so you can get back home without worrying about bailiffs coming to your home
I have to go out to see to my daughter-in-law im her carer she has terminal cancer but I will have this letter done tonightI am not an expert I am self taught i have no legal training any information I post is based on my own personal experience and information gained from other web sites
