Notice of intended court action...

Hi,

I am sure you are very bored of replying to these threads but I am in need of your help.

I parked in a matalan car park and did not buy a car parking ticket. I received a pathetic receipt type parking ticket but ignored it. This was 8/10/13.

Since then I have received letters from debt recovery plus ltd, the most recent today (7/1/14) saying "notice of intended court action".

They are saying I owe £160. I have ignored all letters received as advice read and given to me told me too.

But what should I do? Should I continue to ignore these letters or take action, if the latter, what type of action?

Please help me.

please read the NEWBIES sticky thread at the top of the forum

by the way, ignoring the initial letters was a very bad idea if you are in england or wales, due to changes in the law in oct 2012
  • I have read that thread and if I'm honest, it's very confusing.

I'm just after a bit of advice on what to do next? It all seems very real, and scary.

DR+ will not (indeed CAN not) take you to court. Please answer the following:

    Who are the Parking Company?
    Where is this car park?

PS - any advice saying Ignore in England/Wales was either very old (so you didn't look at the date of the advice), or the person giving it was being malicious. Ignore has NOT been the advice (in England/Wales) for more than one YEAR.
  • Ok, at least that's one good thing.

Parking company = (the creditor) Smart Parking Ltd
Matalan car park in cheltenham, England.

    Noted! Thank you.

What was confusing when you only needed to read the section about debt collectors and Debt Recovery Plus? In the newbies thread, just the bit about 'debt collectors' that gives you advice on what to do next. Easy. Not confusing unless you started to read the whole thing or gave up because it looked long/involved a bit of reading.

Also did you miss the 'Successful Complaints about PPCs' sticky thread? Even easier to understand & follow the advice on that one.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

also complain to matalan direct if you are a regular shopper or can prove that you bought items on that day in question, they should cancel the ticket and then the DR and PPC will have to "go away" and stop pestering you

especially if matalan is the landowner

ie:- they cannot chase an alleged debt that is no longer owed
