GreasyPalm

I earnt £75 through Greasy Palm and they sent me a cheque, but for some reason the cheque was only valid for 30 days. I was away and so unfortunately did not cash it in time. They are now ignoring my requests to send me a new one. I don't know why they adopt this policy - it seems wholly unreasonable - but in any case, shall I sue them?

Cashback payments will be issued monthly, 30 days in arrears providing your account balance exceeds £25. Accounts under this amount will be carried forward to the next month.

GreasyPalm cashback cheques will be void 30 days from date of issue.

Should a retailer delay payment or cease trading then we will make every effort to recover your cashback however GreasyPalm makes no guarantees to payment until funds have been received from the retailer or their agents.

Well, firstly, the cheque may be void, but the debt is still outstanding. And secondly, The Unfair Contract Terms in Consumer Regulations 1999 state:

" 5. - (1) A contractual term which has not been individually negotiated shall be regarded as unfair if, contrary to the requirement of good faith, it causes a significant imbalance in the parties' rights and obligations arising under the contract, to the detriment of the consumer"

That seems to be made out to me.

Why should they try to be so unreasable? Are they seeking to build up a business, or rip people off?

Business & rip people off are pretty much the same thing if your looking at it from a certain perspective.

Why didnt you read the terms and conditions? Or you did read them but ignored them.

In any event, they laid down their terms and conditions and you agreed into it. Why are you blaming them for something you already knew or should of known.

They laid out their business, you enquired and brought into it. Why are you causing a stink now?
