Brought 2nd console but sold as New

I brought a 3DS console from Game today (6/11/14) which was sold as new. The man at the till told me that someone had brought it back sealed and that the owner didn't want that colour.
It was sold to me as brand new.
Upon opening it home, I found that the console wasn't on it's master settings, and there was a picture on it taken 26/12/13.
It was the last one in store.
What's my right on this?
