PCN - Peel Centre Stockport

Hi all,
I recieved a PCN from Excel Parking regarding parking at the Peel Centre in Stockport without a valid ticket (it was dark, we are not familiar with the area and did not see the pay and display signs!).

Anyhow - I have read the masses of info on here and will response with a soft appeal letter. My question is - should I email this or send through normal post? Obviously email is easier, but would I be better sending it through recorded post?

Just wanted to check before I send it off!

    Dear Excel,

    As the registered keeper of (reg) I'm in receipt of your parking invoice xxxxxx dated xxxxxx. I wish to invoke your appeals process as all liability to your company is denied on the following:

    1) The amount being claimed is not a genuine pre-estimate of loss to your company or the landowner
    2) Your signage does not comply with the BPA Code of Practice
    3) You are not the landowner and do not have the capacity to offer contracts or to bring a claim for trespass

    These points and others will be raised with Popla should you not accept this appeal, and you will be expected to provide a full breakdown of your alleged loss, and your full unredacted contract with the landowner.

    If you do reject the challenge and insist upon taking the matter further I must inform you that I may claim my expenses from you. The expenses I may claim are not exhaustive but may include the cost of stamps, envelopes, travel expenses, legal fees, etc. By continuing to pursue me you agree to pay these costs when I prevail.

    Please issue your cancellation within 35 days of this letter, or forward a popla verification code.

    doesnt really matter if its email or snail mail with free proof of posting, long as it gets there

    ideally make sure you get an automated email reply saying they received it

    then expect their rejection and a popla code, so then draft your popla appeal using the ones linked in the NEWBIES sticky thread

    Send it by whatever method the letter allows. I believe email is allowed, so email it, but do not post about the auto-response that Excel send, it is JUST an auto-response and does not need to be read and worried about (as you will read on other threads when you search the forum for the single keyword 'Peel' or 'Excel').

    as a frequent visitor to the peel centre,i would certainly NOT put that you did not see the signs, i hate the scum known as excel with a vengeance,last year they changed their signage,and i can now read it perfectly clearly even without my specs on,sadly i have to admit their new signs are perfect and easy to see and read ,it really does pain me to say this.good luck.

    I appealed a PCN to excel as they were outside the 14 day notice to the registered keeper. They rejected it and said 'whilst we submitted the original PCN in accordance with the POFA 2012, we acknowledge we were outside the delivery timescales for maintaining our rights to keeper liability under the POFA 2012. We are therefore pursuing the PCN under a non statutory route, primarily for breach of the terms and conditions of parking at the peel centre stockport'. Can they do this??
    Sorry to post on this thread but I thought it may be easier than starting a new one and May help with the original poster if there appeal follows a similar route.
