Question on voluntary redundancy

Hiya,

Quick question on my situation to see if anyone can help,

I have a job offer for a new job ( was offered over Xmas ) with a start date of mid Feb, I was due to give notice when I return to work tomorrow.

However, I have since learned we will be called into a meeting tomorrow morning and offered voluntary redundancy. If I was to take the offer of the package offered am I committing fraud? ( have no idea what the package will be at the moment )

Obviously I do not want to do anything that is illegal so not sure if I have to give my notice ( and knowledge of job offer ) prior to an offer being made etc

    Never tell an employer you are leaving till you have an unconditional offer.

    They have no need to know there is no obligation to tell them only give your contractual notice(if required)

    If redundancy is on offer keep very quiet(even friends, tell no one)

    see what the package is and if the termination date fits OK with the potential job offer, if not you may need to negotiate either with the current company or the new one to line things up.

    Be careful of letting the current company know you have a potential job offer when negotiating.

    I am assuming due to references they may know anyway ( although no one has mentioned it to me )

    Will go to the meeting tomorrow and see, just wanted to make sure that legally it was not breaking the law to take it

    Perfectly legal to take any voluntary redundancy payment offered when you have a firm job offer from elsewhere in your hand.

    A reference request from the new employer may alert them to your situation but a reference request is not the same as a job in your hand because offers are almost certainly going to be "subject to the receipt of satisfactory references".
  • and if its voluntary they can pull it at a snap of a finger so don't bank on it, if you get it...great, if not...oh well.
    Don't trust a forum for advice. Get proper paid advice. Any advice given should always be checked

    When I got VR, part of the compromise agreement was that I had to declare any other job offers. And indeed any new job offers which came in during the period from signing the compromise agreement to my last day.

    Why would it be illegal ?

    Why ? Why ? Tell me how paranoid you'd have to be to think that it might be.

    Depending on how much you trust your manager, (and I wouldn't), if there was a chance that they wouldn't offer redundancy (some people might have a special skill or be more valued), you might want to make it known that you would be more than happy as you'll "take a a few months off to see the world, or use the money to retrain as a debt counsellor and go and work for a debt charity".

    Those that took VR when I was selected

    They were given a list of 5 companies they couldn't work for in the six months after taking VR, but I know a couple who worked for a supplier to one of those companies.

    The only problem for the OP is that it's all going to extend the timescale.

    One way of fixing that would be to use all 5 weeks of holiday entitlement to start the new job.

    Where have those 5 weeks come from? Has the OP told us that they are on more than statutory leave, or when their holiday year ends, or that they don't get bank holidays?

    It went well was offered voluntary redundancy package which I told them I would accept and have been able to negotiate an earlier start date for my job as well so will run into each other which is good
