some advise ESA

Right i will cut the story short. I get ESA with the support group. the person i used to live with as we did a flatshare caused me a lot of grief and abuse and my SIT at oxleas have wrote a letter asking the council to rehouse me. the person i lived with caused me to nearly kill myself with his abuse and endless amount of him putting me down and i could not live there as it got to a point where i could not cope as it was everyday of him putting me down, calling me unplesent names and it was going on for two weeks. i dont know why he just came back and started

also i had to move out of fear as he was threatening me everyday and was playing mind games in which was really playing with my anxiety levels and causeing me distress such as saying there were people after me and making me open doors saying im going to get stab up and threatening to throw me down the stairs

I ran out over christmas and have been in between my nans and mums (5 days at nans 2 days at mums)

i need to tell the job centre tomorrow but i been told as i aint got no proper fixed address i lose my support group compent. or if i explain should the benerfit i get be unaffected if you know what i mean

    Your ESA shouldn't be affected.

    Did you receive anything like housing and council tax benefit? They'd be affected if you did.

  • yes i do get houseing benerfit and i think i did get council tax support. but my mental heath doctor has asked me to call the landlord to cancel the tennancy and ring up houseing benerfir to tell them.

    the council has been made aware of my problems and i have spoken to them via e-mail aswell attaching letters from the mental heath services saying that i living there will not improve my mental heath

    but someone said to me as i aint got no fixed address i have to tell them that at the moment i'm living with my nan and they said they can stop everything. i dont know if its true or not

    you need to tell them that youve moved out, but it wont affect your ESA at all.
    as has been saod. the only issue may be housing and council tax benefit.
    will your landlord allow uyou to break the tenancy without a penalty?

    This is not correct. A person with no fixed abode will only receive the personal allowance - they will not be eligible for the support component. This is confirmed in the ESA Regs.

    all the OP would need to do is give either the mothers or grandmothers address as that is where they are staying untilo an alternative is found.
    id be more concerned about being able to break the lease, as once the council are informed that the OP has moved out, the housing and council tax benefit will stop

    Yes, assuming they agree the OP can use their relatives address. However both you and sh1305 said that being of no fixed abode would not affect their entitlement to ESA and that is wrong. Let's just hope the OP returns to the thread before contacting the DWP.
  • right i dont know as i be staying at my nans untill the council sort me out. but as i have a address as temporary will it affect my address as my nan as agreed i can stay here untill everything is sorted out
  • so as im staying at my nans for tempoany in my case it be a tempoany address and shoud not affect my ESA in any way am i correct
