Vinci Parking fine

Hi,

After having a good read through the forum and the success stories I was looking to appeal a Vinci ticket but was just hoping to get a little bit more advice before proceeding.

The driver of the vehicle in question has arrived at a car park used for a cinema complex, the car park is full and several cars are parked against a kirb side out of the way of the main driving passages and in no way obstructing any entrances so the driver has joined them. The driver has then returned to the car to find a ticket for £100 unless paid within 14 days £50 for 'Not parked fully within a marked bay'

The registered keeper of the vehicle has read through the forum and believes the best way to look to appeal this ticket was to aim at:

lack of signage
free car park so charge of £100 excessive
Driver frequent customer of the park and has membership at the gym, cinema and casino.
The driver can also provide at least one receipt for this night as used several of the venues, however much of use was cash.
The driver was going to conclude with requesting the validation code for a POPLA appeal if the charge was not cancelled.

Was just looking to see if people agree this is the right way to go or if there is any extra points you would make or if you would go at it from a different angle?

    sounds about right to me, the NEWBIES thread tells you everything you need to know

    this stroma template is a good starter soft appeal, use it as a basis for yours, but bear in mind you are likely to be rejected and should get a popla code, then use a better appeal for popla
    Dear Vinci,

    As the registered keeper of (reg) I'm in receipt of your parking invoice xxxxxx dated xxxxxx. I wish to invoke your appeals process as all liability to your company is denied on the following:

    1) The amount being claimed is not a genuine pre-estimate of loss to your company or the landowner
    2) Your signage does not comply with the BPA Code of Practice
    3) You are not the landowner and do not have the capacity to offer contracts or to bring a claim for trespass

    These points and others will be raised with Popla should you not accept this appeal, and you will be expected to provide a full breakdown of your alleged loss, and your full unredacted contract with the landowner.

    If you do reject the challenge and insist upon taking the matter further I must inform you that I may claim my expenses from you. The expenses I may claim are not exhaustive but may include the cost of stamps, envelopes, travel expenses, legal fees, etc. By continuing to pursue me you agree to pay these costs when I prevail.

    Please issue your cancellation within 35 days of this letter, or forward a popla verification code.
