County Court hearing for speeding fine

My wife is the registered owner of the vehicle but when the offence was committed, she was not driving and we sent back the notice with a letter explaining that she was not the driver & requested photo evidence, which we received. However the picture is not clear as to who the driver was, so we sent back a letter explaining that there were 3 people in the vehicle at the time & the picture does not show clearly who the driver was. She has now received a summons to appear in court to answer the the speeding fine. Can anyone help us with regards how she can deal with this matter as she was not the driver nor does she know who the driver was at the time of the offence.

This forum really only specialises in private parking issues.
The best place to raise this query in on the PePiPoo 'Speeding' forum where they have regular contributors who will know their way around speeding related summonses. Here is a link to follow.

Hope they can help you (and your wife). Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Chances are the speeding is a (comparitively)minor issue, the failure to name the driver is the much more serious offence. Definitely go to pepipoo.com.I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.0

I hope you get this sorted out. I am still trying to understand how a person can't tell who was driving their car when they know when and where the offence took place."'Cause it's a bittersweet symphony, this life

This case will not be being dealt with in the county court but by the magistrates court.
PePiPoo is definitely the place to go with this.
Unfortunately I foresee an unhappy outcome to this issue saving some procedural error by the police. The speeding issue is likely to have been dealt with by way of a fixed penalty notice, cost £60 and 3 points.
Failing to furnish [the name and address of the driver] on average costs £350-£500 by way of fine, carries a mandatory 6 points and with the MS90 endorsement is likely to substantially increase insurance premiums for some time to come. There have been cases where as a result of being informed of a MS90 endorsement insurance companies have declined further insurance.
Whilst I entirely understand that this might be very worrying to the OP they do need to know what awaits them but other posters also need to understand that when receiving such documents from the police they should not be trifled with. I'm not suggesting that the OP in this case trifled with theirs but others do and there be dragons. My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016).
For those seeking more detailed advice and guidance regarding small claims cases arising from private parking issues I recommend that you visit the Private Parking forum on PePiPoo.com0
