esta NAT

was planning on taking my OH on holiday to vegas for her 40th birthday in august, so applied for esta for both of us and we were declined as we both have convictions for fraud , long story was not done intentional and we pleaded guilt straight away and took our punishment, so i figure i need to apply for visa's for use my question is do you think that we can get one and do you think it will be time for her birthday otherwise there is no point in doing it

    Time wise I would think 8 months is plenty.

    Will you get one ? only the US embassy (or whoever you have to apply to) can answer that I guess

    I needed to apply for a visa due to some convictions. It seemed they were more interested in my intention to return to England, family ties, job, housing and financial situation etc. than the actual offences.

    It seems more hassle now, it was done by post pre 9/11, however if you get the ball rolling straight away there should be time to get a decision, the website currently states 5-8 days wait for an appointment at the embassy,
    although you need to get the police and court records prior to a visit, then upto 60 days for the decision, usually less if the case is clear cut.

    As photome says only the embassy can tell you if you get one, I guess it depends on how serious the fraud was and when it was commited that will effect their decision.
  • Thanx for the replies have already filled visa applications out and have filled out the forms for police records which I will post tomorrow so hopefully can get an appointment by the end of the month ,one other question do we have to leave passports at embassy as are going away for valatines so need passports and would have to get an appointment after we get back if they did

    How long ago were the convictions?

    fraud, as you know, is a crime involving moral turpitude, and may require a waiver of ineligibility depending on the amount of money involved, above or below $250.

    If its below $250 then Petty Offense Exception should kick in, meaning no waiver of ineligibility is required.

    Like others have stated, how longs a piece of string. You may not even be eligible if the convictions were recent and it was above $250.
