Debt Collection Agency chasing me for 1 months gym fee

Hi,

First Post here so forgive me if its in the wrong area.

I recently cancelled my gym membership with Eergie Fitness. The T&C's stated i needed to give 1 months notice to cancel the membership. I contacted them the day after my monthly payment was taken to cancel it. the response i received stated they would take a further payment then cancel the membership. i hadnt used the gym in over 4 months so disagreed with this infelxability and cancelled the DD.

I received several phone calls and letters from Energie fitness stating i owed them £34.99. i ignored them all. I have just received a letter from a Debt Collection Agency named ArcEurope limited stating my detaikls have now been passed to them and I am to pay £52.99 within 10 days ot they may start court proceedings.

My question is, Will this affect my credit score? I dont believe court proceedings will ever commence but what about my credit score.

As far as I know I've never signed a credit agreement (i cant find the original contract). Ive checked my credit report online and can see nothing relating to any gym. My credit score is still excellent.

Can anyone confirm or put my mind at ease and confirm this will not affect my credit score and if i continue to ignore the letters from the debt collection agency nothing will happen?

    Look at your T&C's - only that can confirm whether you gave them permission to wreck your credit file. That said, what you thought was 'fair' is immaterial!

    The date your DD is taken isn't a good basis to work out when to terminate. Your minimum period agreement (if there is one) will be based on a monthly date. Your payment may be in arrears, so if you miss the anniversary date an extra week or two may be added - the terms you agreed are the key.

    Just tell ARC the debt is in dispute and you will not be speaking to them further. Unless they are contacting you to apologize for the error.

  • You need to check the terms and conditions.

    Write to ARC asking for proof you owe the money including where it says so in the terms.

    They say 'may' start court proceedings...not will.

    expect a default on your credit file
    Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.

    Absolutely the best way for the OP to get a default and have his/her credit rating severely damaged for the next six years.

    If one debt firm fails after several attempts they pass it back to the original company who will pass it onto another debt collection firm to try.

    Sounds harsh and may go against the grain but pay them ARC. Get a letter from them to say debt is clear.

    Don't trash your record for the sake of £50 - you could have sorted it by dealing with the firm and escalating the matter and come to a compromise fig. This is what happens when people ignore letters. Learn from it.

    ARC Collections issued me with a CCJ after a similar situation, so I'd pay up if I were you.
