Cleaning up credit file after IVA

I have recently completed my IVA, naively thinking I was home and dry. However, on viewing my credit report, there are many incorrect default dates entered which I am currently chasing up, and the following entry which I would appreciate any advice on.

On my Equifax report, it states under Court Information details of my IVA, with a court date of 31/10/2007 and date satisfied 31/10/2008.

1) the IVA was completed in December 2013, so what does it mean by satisfied, and why is this date a year after the IVA was set up?

2) it states on the report that this information is held on file for 6 years from the date of judgment. Is the date of judgment not the date the IVA was approved and so should it not have been removed by now if the IVA was agreed on 31/10/2007?

So can I ask for the IVA to be removed, or is it 6 years from this date satisfied, whatever that may mean?

Any help would be so appreciated, feel like I am in such a mine field as really want to apply for a mortgage and it is so hard when mistakes made 8 years ago are still affecting you even though you have worked so hard to rectify them.

Thanks

Deb

  • Hi Deb,

I'm no expert on this topic, but have been through similar and experienced the frustration of incorrect records.

My understanding is that it stays on your record for 6 years from the date of commencement (i.e. 2007 in your case) but if you were still paying the IVA 6 years later I expect it would remain on your record at least until satisfied.

Have a look on the Insolvency Register, if your record is on there then you can make a comment against it and ask these questions with the aim of clearing your record. I'm pretty sure it shouldn't be 6 years from the date satisfied in any case. It sounds to me as if your public record should be removed, if not now, then soon.

Once the record has been correctly removed from the register, you can request that your credit reports are updated accordingly. Whilever it stays on the register, I expect it will remain on your credit file. So ensuring the register is up to date should be your starting point in putting things right (it was for me).

Hope that is of some help. I imagine some experts can offer more.
  • You may need to forward a copy of your 'completion certificate' to each of the agencies, along with a request to remove any outstanding 'defaults' or 'notice of correction'.

check as well that you have been removed from the 'insolvency register'.

    Good luck.
