Proof of delivery private parking charge

Any similar experience? Parking charge notice received one day outside of the fourteen day period. I have emailed to state and quote the relevant act. Am conscious the wording says that post age is presumed to take two days unless proved otherwise. What constitutes proof? My word is obviously just my word against theirs. I resent them ignoring the proper process.

    Look at the date of notice to keeper, and the date on the envelope if it has one. The proof is on them to say when posted
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    They usually use stamps, so it should be postmarked.
    They got sick of people re-posting franked envelopes to them selves as it costs them £1.80 every-time.....Until it wears out...:rotfl:

  • All good advice. Have mislaid envelope since receipt this morning but on the case to find it. No date of postage on letter just date of issue 31 dec. will find envelope. Tks? Good advice :-)

    Does the 31st fall within the 14 days? I would put my house on it being posted on the 02/01/14 as they were probably closed on New Year's Eve

    But to be honest, and I fully understand what PoFA says about dates, spending any real time bumping the gums over a day over time is fairly wasteful of your energies when there are much easier and much more powerful arguments open to you.

    Just 4 words will eventually win this for you - 'genuine pre-estimate of loss'. So if you want to spend some more productive time to your guaranteed benefit, please read the NEWBIES sticky thread, keeping an eye out for the 4 magic words.

    Do come back if you're not certain of anything, but the sticky is the most comprehensive online toolkit for dealing with private parking charges.

  • Thanks again all. Envelope one of those prepaid franked ones as second class. Second class doesn't guarantee two days does it. And yes, will totally go back with the magic four words if they think about trying to become pen pals with me. Alleged incident 20/12.

    Delivery is deemed to be on the second working day after posting when sent by First Class post.

    Just to clarify Delivery is deemed to be on the second working day after posting when sent by First Class post unless proved otherwise so it's not an absolute hard & fast rule. The landmark court case on this involved a postal strike delaying delivery but in a civil court everything is always on the balance of probabilities. So simply declaring the actual date that the letter was delivered should be accepted as sufficient proof (as lying is perjury that will get you a jail sentence).

    I think you need to start ensuring you don't become pen pals with them inadvertently via inertia. By not communicating with them early it will start a series of ongoing letters, initially from the PPC as a reminder you 'owe' them, then from debt collectors, which could go on for months and months, with always the risk of court papers coming your way.

    But this can all be nipped in the bud via just 2 communiques - initial soft appeal within the deadlines set in your NtK, then, when the PPC rejects your appeal (with them forwarding you a POPLA code), you appeal to POPLA (with our help) and get this killed off.

    All contained within the NEWBIES thread - just don't let this opportunity for you to control the situation pass you by.
