I was dismissed today - Can’t believe it. I am looking into suing my employers for unfair dismissal. The letter confirming my dismissal states I have five working days to appeal. What I need to know at this stage is (i) what are the most effective grounds for appeal? (ii) if I don’t appeal, will it reduce any employment tribunal award?
working in the legal trade don't you think we need a bit more info on why you were sacked.
Or are you only looking for the best defence, whether it be true or not?
if so just claim they sacked you because you were a black gay disabled old woman, that should do it

Sorry, yes I knew that. I was referring to the fact that I did recall the OP's previous posts (for some reason the OP had stuck in my mind!), and that was the reason I was asking about the final warning. One doesn't have to do a lot to get dismissed on a final warning, whereas if you aren't on one then you have to work a bit harder at it (although I doubt the "priors" will have helped any at all).
But I would have to echo the thoughts of RPW (and several people who responded to previous posts last year) - the writing was not so much on the wall, as generously littered around the room, so it seems odd that the OP cannot believe it. Even by the OP's reasoning, they seem to have an unfortunate ability to be "in the wrong place, at the wrong time, with the wrong people, and able to rub people up the wrong way", and it doesn't seem (from previous posts) that the employer was dead set on them having a long and illustrious career with them. On the other hand, all things considered, it seems the employer has taken an awful long time to get around to something they have had opportunities to do in the past. Easily. Which makes me wonder whether there is a final straw here, and given how many times they have turned away from that straw, just how bad this one is that they have finally decided to end it.
That isn't to say that anyone deserves to be dismissed - but sometimes people can take too many risks when the writing is on the wall.0 -
