Returning unsuitable goods

I went to try and return a Babyliss secret hair curler that were exempt from the 30 day money back guarantee at Argos, was refused my money back because the box had been opened, but in order for me to find out the goods weren't suitable for very long hair, I had to open the box and read the instruction booklet. Does anyone know if there is anything else I can do. Can Argos do this? The goods weren't used.

    Or you could just have read the description on the Argos website and possibly in the catalogue.

    your best bet to get something back is probably to list it on ebay or similar

    For future reference, you can view them in the shop before buying.

    There may be a case for false advertising with this, I was looking into getting one and found conflicting information on the length of hair it works on. This is the actual advert for the item http://www.youtube.com/watch?v=5FJOsTg6D_w

    The picture on the box is of the same woman, she certainly doesn't have short hair (especially before the curling makes it look shorter than it is) my hair is about the same length uncurled but i was told my hair is too long.

    They can't show someone with hair that long as the example if the product is not suitable.

    A boots assistant and my hairdresser, the boots assistant opened the box and read the info inside saying not suitable for long hair. My hairdresser said she's used one before and said they're not that good on long or thick hair, my hair is both long and very thick so no good.

    The difficulty might be that it's open to interpretation.
    The warning on the Argos webpage doesn't state that it can't be used on long hair, but that it can't be used on very long hair.

    The hair on the model in the advert should be okay as the website states that the appliance isn't suitable for hair "below the bust" and the model's hair looks like it stops just short of that.

    But Argos provide contractual rights to return non-exempt goods if you change your mind and can legally impose terms like must be unopened.
