Parking Eye Ticket - Nugent Centre, Orpington

Hi,
I've been reading through the threads where everyone has given some excellent advice but now I'm concerned I may have followed some wrong advice from a different site. Any guidance would be very welcome.
I received a PCN from Parking Eye on 13/11/13 stating the following facts:
Date of event: 04/11/13
Date Issued: 09/11/13
Time in car park: 3 hours 47 minutes
The car park has a limit of 3 hours. On the day in question there was roadworks near the entrance meaning cars were backed up within the car park. You could turn into the car park (and have your licence plate photographed) but it then took a good 10-15 minutes to park. Leaving was just as difficult. The car park has no option to pay for parking in any way as it is a 'free' car park. Whilst in the retail park I visited a number of shops, including Nandos and have receipts totalling almost £60. My mum also visited on the same day, separate car and also received a PCN.
This is what she did: she appealed to PE stating the above facts about the roadworks and the fact we visited a restaurant as well as shopped. She was asked to produce her receipts, which she did and her PCN was cancelled.
I (stupidly) decided that I didn't want to roll over to bullies and send an appeal letter via my husband stating that he is the registered keeper but was not driving the car and asking for a POPLA number amongst other things. On 21/11/13 he received a letter advising his appeal has been referred for further information. It asked him to provide the drivers details and warned that after 29 days from 11/11/13 they will recover the parking charge from him.
So far we have ignored this second letter, which is now worrying me.
Do you think I should respond at this late date and just send copies of my receipts? Should I continue to ignore it and await my POPLA number? Should I respond as the driver and send a different appeal letter?

ideally, as RK he should have sent in those receipts and had the ticket cancelled by PE,
I did something similar for a relative and PE cancelled that PCN too
so I fail to see why you did not do the same as your friend, clearly it was the correct thing to do and PE have a reputation for cancelling tickets in these circumstances , but tend to go to court if they have to (which you dont want)
you should get the RK to reply ASAP and send in copies of receipts and get the thing cancelled and dont be obstinate about it, clearly its causing you stress and so wasn`t worth the extra hassle
the drivers details are irrelevant at this stage so dont pass them on for now, no matter what they say0 -
Thanks Redx, I guess you are right. To be honest it wasn't causing me stress until today when I remembered about it and dug the paperwork out from the mountain of Christmas cards and general festive paraphernalia that had built up on my desk.
I have been accused of being a stubborn !!! in the past and I guess I just got up on my high horse about the whole thing. The tone of the PCN just angered me so much and the charge seemed excessive. I could just imagine someone else, a bit weaker than me paying the money without question and then fretting about covering that fee just before Christmas. But, for peace of mind I suppose sending receipts is the logical thing to do.

most people on here agree with your viewpoint on their letters and bully boy tactics and nearly everyone who comes on here and posts has a beef with somebody or other
but whatever you decide they wont change their ways unless they are forced to by the government or the BPA or somebody on a higher pay grade than us
so follow the simplest path like your friend did, then learn from it for the future, I know I did and I wasnt the one with a ticket !!
I also won one at popla with help from here for another relative , with Excel, so I too learned a lot and learn even more on a daily basis due to the replies on here, which may save my wallet from being opened in the future

Do whatever it takes to kill this off as quickly and painlessly as possible, despite the temptation to dig the heels in - leave that to those who want to fight on the front line and who intimately know the territory.
See how this first stage approach proceeds, but identifying the driver may be a possibility at a later stage, but not for now, and not for concerning yourself with at the moment.

Hi, I just wanted to post back to say that we received an email yesterday stating the PCN has now been cancelled. It's nice not to have to worry about it.
Thank you for your help, even if it was ultimately just a kick up the backside to tell me to stop being so stubborn!
