DIY Divorce troubles

I am trying to divorce my ex and it's not going well. I first filed the papers in May last year, they were accepted (after several tries) and copies sent to my ex.... He claimed he never received them. The second were sent in September (long story but he went through a very tough time) he said he sent them back but that the address he had initially given to me was wrong so I had them sent again in November. He has only just sent them back to the court even though the court ask that he return them within 8 days.... Will they be accepted by the court?

  • I'm sure someone will be along to answer your main question (I don't know I'm afraid!) but surely the papers are being sent by Signed For delivery, so you should know if they have been received or not, and what date they are received? If they haven't been so far then maybe switch to that for further correspondence - more expensive but saves some hassle!
  • Assuming this is an England and Wales divorce, the gov.uk website is really good: https://www.gov.uk/divorce/file-for-divorce and states at paragraph 4 (on the second page) that "If you [the respodent] don’t respond within 21 days, your husband or wife can continue with the divorce as if you've agreed." so looks like you can just carry on without his consent?

    Have you visited wikivorce? They are so helpful and can answer most questions. They were a godsend when I was doing my divorce.

    You will need proof that they have received them, you can ask a court baliff to serve them approx £150.

    Thank you for the replies.... Trying to avoid court bailiffs due to the fees but will give them a ring this week.

    My partners wife at the time didn't return the divorce papers, he was on benefits at the time so didn't have to pay the fees, the bailiffs served her at the school she worked at, she wasn't very happy, but it served her right for being awkward!!
