Default Date - EGG

Hi there,
I had an Egg Credit Card in 2005 which i defaulted on, now Marlin Financial have started chasing the debt.
When I checked my Experian file is shows as defaulted as 2011?
How do I check when I actually defaulted as im sure it was much closer to 2005 than 11.
also if i find it is older than they say how do I get this changed?
To make matters even more confusing I believe I have already served a default for my EGG card, how would I check that?
Thank you in advance
Dan

Hi
Ive just double checked and the account under the name of EGG defaulted in 2005(April) so this should be removed already shouldnt it?
So have Marlin pulled a fast one on me by saying I still owe and registered a new default?0 -

Yes they have. Common tactic from the more scummy level of debt collectors. They slap a false newer default on your file knowing that you'll have to get in touch with them to dispute it. When you do, the scumbags will try to pry some cash out of you.Still rolling rolling rolling......<

so what do I do to get it removed?
and do I stop paying them?0 -
Demand that they correct the date. If they refuse take them to the FOS and report to the ICO.Still rolling rolling rolling......

Send them a CCA request.
Need an original squeaky clean one to get a CCJ.
Then you can decide on paying, but I would tell them that you won't even consider payment until they remove the default.
Egg usually kept the CCAs but not all are good enough. My 2005 loan one is correct.:beer:0 -
A CCA request means what sorry?
What do you mean you need a squeaky clean one? Theyve not registered a CCJ just a default.
If I didnt pay could the apply a CCJ in due course as the default hopefully would be gone?0 -
Bit of a scummy move.
Sounds like when Egg got taken over by Barclaycard, they maybe sold off their 'problem' accounts?
Though mine was defaulted in 2007 and Barclaycard kept it on for the repayments...?0 -

CCA=copy of the agreement you signed
If they don't have the signed original CCA with all the correct contents, they can not be granted a CCJ by a court if you defend it.
If you didn't pay and they do have the correct signed CCA, they can apply for a CCJ which will screw you for 6 years.
Make sense?:beer:0
