Housing Association eviction issue

Hello, and forgive me if I have posted in the wrong forum, but there are so many of them!

Here's the situation in a nutshell:

Stepson (SS) and (GF) have just had a baby (last week in fact). GF also has a young child. GF and children were recently placed in a Housing Association flat due to homelessness. She is now on the priority list for housing, and probably has a couple of months to wait as she is high up the list. SS has been staying with them as he's the father of the new baby. However, the Housing Assocation doesn't take too kindly to SS staying overnight and have threatened her with 'eviction' if SS persists.

My question is: Can this be done, i.e. can somebody with dependents and a supportive father be evicted?

    It depends on the contract, when I lived in a council house only dependents and those name on the lease were allowed to reside in the property for more than 7 days in any 30 day period unless I sought permission in which case some exceptions could be made.

    If he is staying over and she receives any benefits, she would also need to declare a change in circumstances unless he is only staying a few nights a week.

    Has she declared to the benefits people that she is in a relationship and are they claiming as a couple or does she claim benefits as a single parent?

    I don't know the answers to those questions, I'll find out. I realise that would make a difference, but what?

    They are claiming as a couple.

    If they are claiming as a couple, why would she have been given accommodation as a single mum?

    More likely she is claiming as an individual, got the flat as she was pregnant and moved the BF in as soon as she could... it's called playing the system.

    Why increase the size of the family when they don't have the means to support themselves?

    Is the flat in a homeless hostel type place? We have one near here that is for homeless people waiting housing, but if you enter as a single person they do not look too kindly upon you then moving a partner in and expecting to be housed as a family, understandably so.

    I think it depends on the accommodation - temporary hostel type things do have rules on people staying, but I would think they need to be rehoused as a couple with two kids, probably into 2 bed accommodation, which I would imagine mum + 2 kids would be entitled to anyway.

    Best ask the HA about setting up the permanent tenancy, when it comes, as a couple.

    You say GF and children were placed in homeless hostel not the family but they are claiming benefits as a couple is that correct?

    In answer to your question yes they can evict her depending on the conditions of the tenancy. If she was given priority homeless as a single person or the homeless accommodation is for single parents then she will be breaching her conditions by allowing him to stay. Is there no family homeless accommodation?

    Also if she has claimed HB as a single parent then the HA will not want the claim to be stopped due to fraud (having a partner) otherwise they may not receive any rent.
