Help -- Euro Car Park Fine

Hi,

Please can you give me some advice? I had been parking in the same spot for over 2 years in Manchester (between some old disused railway arches and an ECP car park. There was a fence separating the car park and I parked in an alley that was overgrown with weeds). I parked there every day Monday to Friday with a colleague. Some other people blocked the other end of the alley. One day I came out of work to find a parking ticket. 4 cars in a row all had tickets. Well myself and my colleague have appealed against the fine stating we were not parked in the stated car park, there were no marked bays and no clear signage. We also mentioned we had parked there for years with no warning that ECP were taking over.
My appeal was rejected, and my colleague has still not heard. This happened in November. According to the rules at Popla am unable to appeal as it has been longer than 28 days.
There is no address to write to ECP other than the appeals address and no phone number. I think I'd like to take my chances in court. What would you suggest????

    plenty of info and links in the sticky thread at the top of the forum, titled NEWBIES - READ THIS FIRST , so please read it

    when you appealed and it was rejected you should have been given a popla code by the ppc

    check if they gave you one, if not write to them again and complain about it

    if they refuse etc, report them to the BPA and the DVLA

    lastly, it is not a fine, they cannot fine you

    its a parking charge invoice !

    this is england , not scotland, different rules apply , so if you dont know the rules, dont take part

    ECP don't do court as yet - but you never know.

    You should simply be beating them at POPLA like we all do - and it costs the PPC over £30 a pop. Why do you say you are too late, was the POPLA code generated over 28 days ago? If so then at least get your friend to follow the 'Newbies' thread info on 'How to win at POPLA' when he gets a code, and in your case you could TRY to just use it of course, especially as POPLA now have a backlog of appeals and are closed until Monday, you may just sneak it in!

    Please read the ''Private Parking Ticket? Even an old one? Newbies please read this first!'' sticky thread near the top of the parking forum. There's a link 'How to win at POPLA' and it doesn't include 'don't bother if your code is over 28 days old'! Try ANYWAY seeing as it's only a matter of using an example POPLA appeal on that link and adapting it a bit!

    If you don't get your POPLA appeal accepted, and are now going to simply ignore the letter chain like we have done for YEARS (myself included, my first fake PCN was from ECP!) then there's a whole section in the Newbies sticky thread, about debt collector letters. Obviously don't ignore actual court papers and remember a firm has up to six years - so keep the letters, all of them.

    But your priority should be to bung in an online POPLA appeal anyway in the next 48 hours, without mentioning the date of their rejection letter. Easy. The 'Newbies' thread is on page one and my signature below (not the red bit) tells newbies how to find page one of this forum - one click away.
