UKCPS final notice!!

Hi, I have recently recieved a 'final notice' before court proceedings letter from UKCPS, demanding I pay £125 after ignoring the previous 2 letters. I was surprised to receive the ticket at first as I had never heard of this "car park" despite living in my home town all my life. After googling the address I now know where this car park is and have parked in this area few times before as have other family members and never once recieved a ticket. This 'parking charge' was sent through the post, I did not receive a windscreen ticket. Having observed the area there are no cameras about that I can see and the car park is not very well sign posted stating it is a private car park and only valid permit holders can park here but that doesn't mean there isn't signs :mad:. I have missed the date to appeal by but was wondering what you guys thought should be my next plan of action, should I continue to ignore or should I appeal?? The latest letter I recieved is the exact same as the links someone posted showing the different letters others have had. Thanks

you should read the NEWBIES - READ THIS NOW sticky thread as its all explained in there, its also never too late to appeal, not until court letters are issued (it tells you this too)
but if they dont give you a popla code then you can either pay up, or go to court if they issue court proceedings against you

Take a look at that which may assist. You have 2 options, 1 is to appeal and the other is to ignore.
I have seen a lot of posts on many forums which state people have ignored these and the "problem goes away" after a number of months but you need to be patient and not get to scared about the content which is borderline harassment. These are invoices NOT fines (fines come from the council) with very loose backing. A lot of people suggest appealing could make things worse as you have acknowledge the receipt of the letters, and they will either ramp up their scare tactics campaign (including sending letters from solicitors - most of which are their own internal solicitors which share the same address). As far as I understand, only a handful of cases have ever been taken to court, but these are more "test cases" but generally costs them more money than they would get back.
Only you can make the call as to how you move forward though. If it was me I would ignore unless I have concrete proof that the invoice is not valid (been there and done that, 4hr stay on a 3hr spot but I was exempt from the 3hr due to being on a speeding awareness course)0 -
Having examined the car park again in my opinion the sign posting is less than adequate however ukcps may not agree as there are signs, albeit, small ones. Having said that the ticket is addressed from Leeds and I live nowhere near Leeds so I can't imagine they'd drive out and check it as I believe I was done by a "self ticket" person in the few moments the car was left there. I think I may go down the ignoring road and see where that gets me and live in hope they give up. Should I have a back up plan just incase maybe???0

ignoring is the stupidest action anybody can take in E+W
coupon-mad makes that extremely clear in her signature and the newbies thread
its one thing being coupon-mad, quite another to be just mad - period !
proactive and intelligent "beating them at their own game" is the only way forward in this, otherwise you run the risk of a court appearance when you will have no option but to deal with it, one way or another
but as you have ignored them until now it may be one choice , others may feel you can still appeal at any point up to the court letters0 -

Ignoring still works for a statically large percentage .
Myself I now prefer costing them money, but if you are to post facts, they need to be accurate.

You need to respond within 14 days acknowledging the Letter before Claim and then respond ROBUSTLY REBUTTING THEIR CLAIM before 28 days is up.
You would be mad to ignore UKCPS at this stage unless you like court claims. They ARE litigious and are one step away from a court claim. YOU MUST RESPOND. Please read the linked thread so you see what's needed, and post here with any questions. The thread you posted on at first wasn't even about UKCPS!!
Don't respond to any private messages offering 'help' because we are fairly sure that UKCPS read this forum and have allegedly contacted people like you to find out who you are. Don't let that happen, be wary and respond. Having said all that if you do end up with court papers you can still defend - but I know what I would rather do.

no interested in your "statistics", I merely gave my opinion which as this is a forum I am entitled to do so !
Also not interested in if you like my opinions or not so dont troll my answers or tell me what to do or not do either, as I do not like that patronising and condescending tone of your reply !
I never said my answers are accurate nor ever claimed them to be, nor did I say I was an expert in this field either nor ever claimed to be

I believe that ignoring these letters etc in E+W causes suffering and I believe in being pro-active to try to stop these matters getting out of hand, so I will be IGNORING your IGNORE statistics and refuse to change my opinion on that particular issue
therefore, do not tell me what I should or should not be doing in future, its not your job, you are not my teacher and its not your homework you feel you have to mark !

The OP started out on a UKPC thread which was totally irrelevant seeing as UKPC don't do court.
However UKCPS do, sometimes!
But there are set ways to respond to a LBC to rebut the points and try to divert the case to POPLA even at a late stage. The OP should make the case a clear 'hot potato' which will be robustly defended and not worth them pursuing. Can be done, and UKCPS are also beatable in court - as per UKCPS v Murphy 2012.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I'd like to thank everyone for their input and I'm going to write a letter of appeal, in your opinion what would be the best points to address in my letter, should I go down the "lack of signs" route?? Not got a lot of experience in this kind of thing haha0

As the registered keeper of (reg) I'm in receipt of your parking invoice xxxxxx dated xxxxxx. I wish to invoke your appeals process as all liability to your company is denied on the following:
1) The amount being claimed is not a genuine pre-estimate of loss to your company or the landowner
2) Your signage does not comply with the BPA Code of Practice
3) You are not the landowner and do not have the capacity to offer contracts or to bring a claim for trespass
These points and others will be raised with Popla should you not accept this appeal, and you will be expected to provide a full breakdown of your alleged loss, and your full unredacted contract with the landowner.
If you do reject the challenge and insist upon taking the matter further I must inform you that I may claim my expenses from you. The expenses I may claim are not exhaustive but may include the cost of stamps, envelopes, travel expenses, legal fees, etc. By continuing to pursue me you agree to pay these costs when I prevail.
