I'm married but have been separated for 9 months, my passport has expired and I want to get a new one, I was wondering if I'm able to get one in my maiden name even though i'm not legally divorced?
From what I understand, it's up to me whether I use my maiden name or married name?

You can use whatever name you like, married/divorced... makes no difference. Just make sure that whatever you book (flights etc) matches the name on your passport.0

Which name is on your current passport?
If it is still in your maiden name then it is easy to renew in the same name.
If it is currently in your married name then you will need to demonstrate that you have reverted to your maiden name for all purposes. I used my decree absolute but they will also accept a decree nisi and quite possibly other documentation also.MSE aim: more thanks than posts :j0 -

Give them a call to check, but if you can evidence that you use it, they're usually good for whatever name you want.
For example, I changed my surname when I was 7 in terms of usage, but it was never done properly (Deed Poll etc). I just started using the new name for everything - bank accounts, school etc. My passport is in the "new" surname with a note confirming that I am also known as my "birth" surname. It's a bit of a hassle explaining it to the Passports Agency so I usually attend in person to get my passport renewed, but so far so good and I'm on my third.0 -
My current passport that expired nearly three years ago, is in my maiden name, I'll give them a ring anyway because I don't know whether I need to include my marriage certificate or not. Thanks.:heart: Think happy & you'll be happy :heart:

If you change your name on marriage, you don't give up your birth name. It's still yours.
Also, you don't have to stop using your married name if you divorce.0 -

If you never got a passport in your new name, then surely all you need to do is apply for a new passport with a renewal form? They wouldnt even know you had changed your name on other things.0 -

You just renew it in your maiden name then, there's no need to tell them that you were once married and didn't ever get a passport in that name or include a marriage certificate for a name you don't want the passport in.Accept your past without regret, handle your present with confidence and face your future without fear0 -

I've just renewed my passport in my own name, having never changed it after two marriages. Just renew it normally, no other information needed.0
