Annual Statements following IVA

I entered into an IVA in November 2007 which was registered as being satisfied early in 2008.

Despite this I still receive an annual statement of account from one of the creditors dealt with under the IVA. Each time I receive a statement I write referring to the IVA and ask them to contact the IP that dealt with the IVA. They make no other contact and have never asked for further payment but I would like to know if they should still be sending the annual statement and is there anything more I should do.

The IVA and the defaults that led to it no longer show on my CallCredit report and I am in the process of checking the other CRA reports to see what they show.

    Can't remember if Tesco issued those in their own right, or got a 3rd party like Santander or the old Alliance & Leicester/Abbey to do the finance on their behalf.

    Anyway, if you have been discharged from the debt due to completion of the IVA then they should not be sending you those statements.

    You could complain, and take it to the FOS if it really bothers you, but in most cases like this it's debatable whether it's worth the hassle.

    What I would check if you haven't done so already is the status of this on your credit files? They should have a default for the account registered, and the date of that MUST be no later than the start date of your IVA. That MUST be the case so that the account drops off your credit report when the actual IVA does, leaving a clean file. The debt should also be marked in some way to show that it is "satisfied".

  • Thanks for the advice, it doesn't bother me too much as they aren't asking for payment. It's no longer showing on the CallCredit report although it was until recently (which fits with the 6 year cycle). I'm in the process of checking the other two.

    I think I've probably written to them enough times now to confidently throw future statements in the bin. Just wanted to check and see if there was anything else I should be doing.

    If the debt is still shown on my credit report would it be the creditor that needs to be told to get it removed or the CRA by providing a copy of the IVA?

    It's the creditor that would need to correct the default date, which would have the effect of it being removed from your report.

    You can dispute it via the CRA as well, and in rare cases they will remove them. Mostly however, even with proof such as an IVA completion, the CRAs will only query with the creditor and will leave it on if they respond that it's correct.
