Ofcourse they do and the op should issue a s8 notice. This is legal advice, the ll is running a business. If they can't afford this kind if situation, they're in the wrong business
U can peruse non payment through court. If the tenant can't pay, then you should do better checks.
And no I'm not anti landlord, just pragmatic
I just think its unnecessary to criticise the OP when she has done nothing wrong in this case. They have merely asked for advice on how to move forward given the situation. Who knows what position they were in when they started the business? Maybe finance was more secure. Should HMV/Woolworth's/Game etc never have set up business because their crystal balls told them the whole retail landscape would change at some point in the future?
Maybe they are taking steps to help their situation - if we got in financial difficulties we would be best off selling our house and moving into our rental property....... I'm making this up but I would imagine there is a good reason they want rid of a previously good tenant.0 -

I didn't say that members said the tenant shouldn't pay rent.
I said the tenant has not paid rent(for two months), yet members are saying that the non rent paying tenant shouldn't have got a notice to expire at christmas. Cry me a river.

Agreed, and the tenant should pay rent, absolutely. But the ll should look after their interests too, these things happen in business.0 -
Question: If I tried to stay in a hotel, knowing that I did not have the means to settle the bill, would this be
a) Illegal?
b) Immoral?
If your answer on both counts is "Yes", then why is a residential rental agreement any different?

So, if I follow all the xmas well wishers right, had the landlord given an extra month, then the tenant wouldn't have got their housing benefit suspended(for fraud or not).It's called logic
