Housing Benefit Question

Hi
My oldest son (18) stays at his girlfriends a minimum of four nights per week during term time and full time during all school holidays (she is a assistant teacher).
He left college and has no income because his claim for JSA is not complete due to him leaving an original letter from college at the job centre and them then loosing it.He wouldn't think to ask for it to be copied etc :(
Since December 12th he has slept at home on only four occasions.
My question is for housing benefit purposes is he classed as living with her.
As far as I am concerned he moved out on 12th December but she can't fit all his stuff at hers so all his guitars etc are still here but they do all his laundry etc.
I am going to send a letter to my council explaining the above but do I need any further proof he has moved out.Relations are not good between us and I doubt he will sign anything.

    If he is living with her he will likely be entitled to very little as partners are expected to support each other so any benefits will be based on their combined income.
    Income based JSA will not be paid if she works over 24 hours per week
    They could make a joint claim for housing benefit if they are in rented accommodation

    Yes the are most certainly living together for benefit purposes.

    The rented accommodation is in her Mums name who they will be living with.
    His girlfriend only works 17 hours I don't know if her and the Mum claim any benefits but I suppose it is up to them to tell the appropriate people.
    I don't think they have thought that my son won't be entitled to any money if he continues to live with them.

    Social but even with him gone we don't have a spare room for bedroom tax purposes.

    Depends how fussy they want to be - normally a signed statement from you with his forwarding address and date of vacation should be enough.
    These are my own views and you should seek advice from your local Benefits Department or CAB.
