Quick question regarding POPLA appeal online..

Hi everyone, happy new year :)

I'm just filing out my POPLA appeal, related to this post here.

I'm just wondering which of the 'grounds' POPLA ask you to choose I should select based on the grounds I'm actually appealing on. They force you to pick from 4 categories:

The vehicle was not improperly parked:
e.g. that the vehicle was not parked where stated on the parking charge notice; that you believe you were still within the time you paid for; that the voucher was clearly displayed or that the conditions were not properly signed.
The parking charge (ticket) exceeded the appropriate amount:
e.g. that you are being asked to pay the wrong amount for the parking charge or that the charge has already been paid.
The vehicle was stolen:
e.g. that the vehicle was improperly parked after being stolen. However, the fact that someone else was driving your vehicle, for example a family member, friend or colleague, is not in itself a valid ground of appeal. The fact that you told the driver that they could only use your vehicle on condition they did not get any parking tickets is not a valid ground of appeal.
I am not liable for the parking charge:
e.g. that you had sold the vehicle before, or bought it after, the alleged improper parking. However, the fact that you had paid to park the vehicle in the first place (even if, for example, the voucher was not clearly displayed) is not in itself a valid ground of appeal.


I'm appealing primarily on GPEOL, and I'm including some other elements relating to bad signage, possibly my right to park due to the lease on my flat (I was done by the PPC in my private parking space).

The stolen car point isn't applicable, so which of the other 3 should I use? I first considered the 4th - I'm not liable for the charge. But that last sentence there makes it sound like I might be shooting myself in the foot with that one.

I've done plenty of reading and had plenty of advice, and I'd hate for this to go t*ts up over picking the wrong point here.

    Can you explore this lease ?
    What does the lease say in regards to the space.
    I doubt very much it conveys a right to a private company to conduct commerce upon your lease holding.
    Thats is what they are doing.
    Have a good read and let us know what it says, if it makes no mention of allowing someone to conduct commerce upon your lease holding, then an invoice for some rent to the PPC must be a logical step

    Submit it online, tick 3 out of 4 boxes because ALL except the stolen car one fit any POPLA appeal.

    Include the fact they have no authority from the landowner and need to show their unredacted contract (as per example POPLA appeals you will have read). Sometimes no GPEOL doesn't win, sometimes POPLA go for 'no authority/contract with landowner shown'. So have both killer points among your other points about signage etc.

    Show us your draft if you are certain you have time.
