Parking Eye - Parking Charge Notice, Scotland

I have just come back from holiday and found 2 parking charge notices from Parking Eye in the mail.

It seems I overstayed by 11 minutes in a retail car park in Scotland. The first letter is a week after my alleged overstay and the second another week after that. The parking charge notice is asking for £80, discounted to £48 if I pay within 14 days.

There is a timed picture of my vehicle entering and leaving the car park, driver image is not visible.

The letter has an approved BPA member emblem on it.

Something in the back of my mind reminded me that these "notices" are best ignored. However, having now read forums for several hours I am slightly confused!

Should I pay it, or is the best advice still to ignore it? Any advice gratefully received

    In summary: throw them in the bin, if more letters come, throw them in the bin too

    Please don't follow the above advice, don't ever throw letters with such demands in the bin, keep them filed away.

    In terms of what to do, as you are in Scotland there is no keeper liability, so only the driver can be held responsible, if you don't tell them who that is then they can't make a claim with certainty on who is responsible.

    The advice is for now to ignore parking eye unless they send a notice before claim, so watch out for it as parking eye are known to abuse the small claims track by issuing claims there even though it is out of jurisdiction.

    But make complaints to the retailer or landowner about this, show scans of your receipts of this, be assertive and complain to store manager only or their head office.
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    The 'offence' was committed in a retail car park in Scotland but it's not clear whether the OP is resident in Scotland or not. In either case the advice is the same. Keep the letters but ignore them as only the driver can be held responsible & PE don't know who the driver was unless you tell them. If their letters try and pretend that the keeper of the vehicle is responsible then you could report PE to Trading Standards as that is a lie as POFA 2012 with conditional & limited keeper liability does not apply in Scotland.

    So none of the tickets are enforceable if issued in Scotland against an English RK?

    The OP said they were holidaying in Scotland so I would assume they lived in England or Wales.

    Correct. No more than they are enforceable against a RK resident in Scotland. Any alleged contract will have been under the law of Scotland.

    The OP said that they returned from holiday NOT that they had been holidaying in Scotland. Don't ASSUME.

    No the registered keeper is not liable as the Protection of Freedoms Act 2012 does not apply there, so no keeper liability can be enforced. If they try and use it they will drop themselves in it. As Nigel said the thing to do is ignore for now
