parking charge motorway services after 8pm

hi we received a charge. I wrote to them initially saying we as a company didn't know who the driver (company car) was but as it was for 2.5 hours £60 charge was excessive considering the charge for 24 hours was £10. we offered with out prejustice a £5 offer.
parking eye have written back confirming they have it in their appeal stages and require us to provide a drivers name otherwise they will persue payment from our company.
the car was parked from about 8.30 pm to about 11pm on a motorway services near Sheffield and there were next to no cars in the car park when it left. the inside was having major refurb and signage was un noticed.
do I give a name and then appeal, or refuse. 2 hours is stupid late at night especially when there is so many signs saying stop and rest. stop if tired, yet parking charge signs unclear and un noticed ... ive seen a few threds on here but so many now morrisons/motorway/pcworld etc etc
please advise

Is this England or Wales ? Have they given you a popla code ?When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

Skim reading this time Stroma (easily overlooked)- last time I checked Sheffield is indeed in England!
@34Coupe - from reading the OP - it is your own company that the car belongs to I presume?
If so you need to write back to PE:
The the registered keeper is fully entitled to make an appeal without naming the driver and you are well aware of this fact which is detailed in the code of practice by the BPA.
A complaint is being made to the BPA and DVLA and you suggest therefore:-
They must supply the POPLA code or accept the generous £5 without prejudice offer and cancel the remainder of the parking charge by return to avoid any further embarassment.
Should they continue to press this matter further by refusing your offer to settle this matter by return and no later than7 days - when this offer expires, then you will be raising a counterclaim for damages for your time and costs in dealing with this matter at a court rate of £18 per hour and will include any costs incurred such as stationery, stamps and legal costs.
(What a shame you offered them even £5)0 -
Interesting approach and one I recently took with RPSS (Re a train travel Penalty Fare).4consumerrights wrote: »Skim reading this time Stroma (easily overlooked)

Would a County Court judge be likely to allow a claim for these charges, would you know? I often make this kind of threat with no idea if it's enforceable as far as an actual claim being made for these costs alone succeeding.0 -
It's been discussed here and the feeling from a Solicitor was that a claim by a victim of a PPC for damages/costs has real prospects of success if you outline your costs at every opportunity, particularly nice and early. And if you state your case (appeal reasons, such as no GPEOL) to show their claim and whole reason for proceeding is without merit, since we all know PE lose every time at POPLA on 'no GPEOL'...no genuine pre-estimate of loss shown. The point having been made that PE are wasting the person's time to proceed, when they know they lose at POPLA every time no GPEOL is raised. And after all, an MCOL punt only costs about £35 for a small amount being claimed. Biker Paul on pepipoo has served papers on ParkingEye already.
As for the OP, we need to know if he/she is a POPLA code stage? A simple link of examples called 'How to win at POPLA' is in the 'Newbies please read this now!' sticky thread near the top of the forum.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
