ebay

I bought an item on auction which cost £86 including P&P on the 15 December, the seller posted it out on 18 December

I still haven't received the item through the post, the seller has sent it first class and not tracked.

I have contacted the seller and he has asked me to wait until 9th January which he says is the earliest he can claim off the post office for a lost parcel.

Is it acceptable to wait until the 9 Jan or should I be making a claim for a refund now? I'm a bit concerned as the post is normally quite reliable here and also that I wont get the goods or the refund.

It is not illegal to open another persons mail unless you intend to commit fraud - this is frequently incorrectly posted:)

    It is not your concern as to when the seller can claim. You contract is with him. He has a contract with Royal Mail.

    If it's eBay, simply open an "item not received" claim. You will win.

    EDIT: Yes, it's clearly eBay cos of the thread title! Use eBay's claim procedure. Cover your own back.
    One important thing to remember is that when you get to the end of this sentence, you'll realise it's just my sig.

    open an INR case today if it still hasn't arrived. The case will remain open for 10 days at which point if seller has not refunded and the item has not arrived it can be escalated and your funds will be refunded.

    If item arrives meanwhile the case can be closed with no harm done to the seller. If seller refunds before case escalated then again it does not affect his account.

    It is a poor seller that uses the 15 working day rule to try and stop a buyer claiming a refund and I would not be happy with leaving perfect stars for such a seller.

    I did the same with an item from China. No item arrived after about 3 weeks. Seller sent another but because it didnt arrive by day 44 i opened a case. A day or 2 later it arrived. I closed the case.
