Aaahhh! Landord wants to deduct £420 from deposit!

    Does your contract specifiy the house needs to be professionally cleaned? Ive had several that have.

    No it doesn't say that. Before we moved out they left a list if things to do like clean the oven, toilets etc and a few random things like weed te garden and which I said no to as it was pouring it down with rain for a week and it was the same as when we moved in.

    No it doesn't say that. Before we moves out they left a list if things to do like clean the oven, toilets etc and a few random things like weed te garden and which I said no to as it was outing it down with rain for a week and it was the same as when we moved in.

    U only need to bring it back to the state it was in when u moved in.
  • Turn the around another way , would you want to move into a house where the carpets had been run over with a DIY steamer carpet cleaner ?
    All our property have their carpets cleaned or if too bad replaced ( at our expense if wear and tear) if the tenant does not have them cleaned then we have them done copy the invoice and charge it .
    I have in the past accepted a clean where tenants have hired a professional machine and done it themselves but it is impossible to get to the same standard without using one.
    This all said It costs only around £90 for a four bed house to be done ,here in Yorkshire anyway so don't be fooled by an agent in this regard.
    So my advice would be if it says professional clean or to a professional standard get it done .

    Your advice is wrong and I hope all your tenants get advice about this before paying you anything.

    It needs to be the same as when u move in, less wear and tear. That does not need a company being hired.

    Perhaps you should do some research before u invoice your tenants... Since those terms are not enforceable

    U cannot be forced to use a company, if they try to enforce the clause they will need to prove a 'loss' which won't be applicable if u return the property to the state at the start of the tenancy less wear and tear.

    This is obviously an area of contention for both tenants and landlords. The definition of 'wear and tear' can be so strictly defined that huge chunks of a large deposit suddenly 'disappear' into the cleaning costs getting the house ready for new tenants. The tenants are usually left high and dry and embarrased that their lack of 'cleanliness' has cost them so much money. It's an unjust situation but then you do often hear of tenants from hell and in those circumstances landlords are justified in keeping all the deposit. Small claims courts are effective and you can often go in as a litigant in person and state your case.

    I'm sorry but no:

    A: the deposit protection schemes arbitrate this, no need for court.

    B: wear and tear is the decline in quality from normal use. So carpets getting worn, paint rubbing off. Damage from bad tenants is very different.

    C: some tenants don't know their rights and forego their deposits when they shouldn't, some landlords see the deposit as a sinking fund. These are both bad situations.

    D: nine of this relates to paying for a professional clean. Everyone is able to return a property to the state they receive it
