A ticket from NCP for parking in a permit bay

Hi there,

My elderly mother received a PCN at a railway station about 2 moths ago. She had paid for a ticket, however unfortunately due to her age she was not aware she had parked in a "permit bay holders only" section of the car park.

I my self visited the car park to see the permit bay section, and not to my surprise...it was inadequately signed and of course hidden so you fall right into their trap! I found it difficult to find let alone a women of 60 years of age with bad vision.

I took the forums advise and have waited for the NTK to arrive. It is all written well and they have not broken any rules of BPA.

I tried to find a good letter template which will represent my case well, "Inadequate signage and proof of any loss to the PPC" but I have not come across any yet. I would very grateful if anyone could help direct me to the right direction and possibly give me any further points to add to the letter and either get the fine cancelled or win with POPLA.

Dear NCP,

As the registered keeper of (reg) I'm in receipt of your parking invoice xxxxxx dated xxxxxx. I wish to invoke your appeals process as all liability to you company is denied on the following

1) this charge is not a genuine pre-estimate of loss
2) your signage does not comply with the BPA Code of Practice
3) you do not have the authority or permission to issue invoices at this location

If you reject this appeal please forward a popla verification code so an appeal can be made there, I will be asking for a full breakdown on the above, as you know all appeals are upheld on the points raised.

Please issue your cancellation within 35 days of this letter

Should your mother be driving the car at all if she really does have 'bad vision'?

The OP's opening first post doesn't sound right to me.

It reads like anyone over 60 is expected to be unobservant and incapable of making decisions.

It's perhaps unintentional but I see it as ageist and sexist.

I do hope this is not another 'wind-up merchant / troll.

In the 'Have you got a private parking ticket? Newbies read this first' sticky thread at the top there are a dozen examples, most of which include those points.

By bad vision i meant she wears classes but perfectly capable of driving.

Iceweasel I can assure you I am not an ageist nor a sexist, as I was speaking specifically about a person, not in general. My mother would not be someone I would speak of wrongly either. Also I believed this forum was to help one another with PPC's...not to scrutinise an individual who needs help.
