Hi mery xmas to everyone.i thought i would give my rant over the board as to seek advice /help of my situation.
I live abroad in an eu country and i recieve esa from uk back in june/july i made a claim for pip which i was informed by the royal british legion i could do this i did promptly.jump forward to sept i get a phone call from pip/dwp telling me my case is still with atos maybe i should phone them and find out whats going on!
Fw today dec 30th i get a call from pip/dwp again from the case officer which i was expecting since 20th dec!he explained he will ask atos what is the problem.
He did mention it might be a case of the medical evidence sent by myself at the begining is not in english,i assured him it was all in english from the esa /dwp when i got my esa medical back in nov 2012 this i know he knew but maybe he was trying....
And to cap it all he also said if atos say the evidence given is not enough i might have to go for another medical like i did with my esa back in nov!!
So here is the bit i dont understand.if my medical evidence from my esa medical in nov 2012 is not enough what will a new dwp medical prove other wise if i am to go through the same process as i did in nov.
I get the same sort of med which is european style not like the atos/capita ones in uk so the answers on the medical will be the same...will atos except it then?if so why not my nov 2012 med reports from dwp/esa?
Can anyone tell me if this is proper offical way this is being handled?after being passed pillar to post since sept via phone calls i think both dept have been stumped at my case and both depts didnt want to do anything without being shoved.alsi think they have done this with their eyes closed.
Now it will take approx 6 months to be informed they are going to send me a date for a new medical tehn another 3 months for the local nhs to tell when and where...then if i can actually go might not due to health it will take another 3-4 months for the report to be sent back to the dwp assesed and translated and maybe and just maybe i might get answer before xmas 2014!
Any help /advice would be apreciated.

You can only as I understand it claim the care component (assuming you meet the criteria mentioned below).
Any mobility component cannot be claimed.
Are you getting contributory ESA, in the support group, after migrating from IB?0 -

- you're covered by certain European Union co-ordination rules, which protect your right to claim benefits when you move within Europe and
- you can demonstrate a genuine and sufficient link to the UK social security system.

As you receive ESA from the UK and they are therefore responsible for paying your health costs via the S1, this will be considered to be an adequate link.
However, you might well find that year old medical evidence isn't considered recent enough and you might not have appreciated that the eligibility criteria for DLA/PIP are different, so it is possible to be eligible for one and not the other.0
