3 for 2 problem

Before Xmas I purchased 3 gifts on a 3 for 2 basis priced £15 each.
One is electronic and doesn't work. I took it back for replacement but they have no more of them and wont be getting them back in.
They offered a refund and took the receipt but then announced the refund would be zero because the remaining 2 items cost the same as 3. I came away with the receipt and the item that doesn't work.
Any thoughts?

I would say that the contract was for 3 items for £30, and they have only supplied 2 so you should be given a £10 refund. The 'free' item wasn't a gift, it was part of the contact and you may well not have bought them at £15 each. There's also no reason for them to say that the broken item was the free one.
I'm not certain what happens in this situation though, so will be interested to see what others think.0 -

Did they offer you any other suggestions? They are in the best position to advise.
Can you take all 3 items back to get refund?0 -

Id have to disagree. It sounds like this offer was "3 for 2, cheapest item free" - which is completely different to a "3 for £30" offer.
Personally id be expecting a replacement, or staff allowing you to exchange the item for something else in the "3 for 2" deal.0 -

I think I misread the OP. I thought it was 3 identical items but reading again it sounds like 3 different items that are coincidentally the same price. I don't think that makes a difference though
My reasoning was that its not possible to buy something for £0.00 because there can't be a contract with no consideration from the buyer. Since the 'free' item is dependent on purchasing the other two items it's clearly part of the contract, so I don't think it can be free.0 -
You should choose something else for the same value. They can not give you a £10 refund as the item cost £15. If you had only bought two items you would have still paid £30. They can not refund you £15 as you would then have two items for £15. The three items could be returned for £30 refund. To clarify, it was 3 items with the cheapest free, prices ranging from circa £7 to circa £20.
I happened to chose 3 the same price but each is different. The other 2 have been given as presents, as has this one, so cannot take all items back.
I was not expecting £15 back but thought I would get £10 apart from the fact I was hoping for a replacement.
The comment that stated it cannot be assumed that the faulty item was the "free" one is spot on.0 -
Can you tell them that you will keep the "free" item and that they just need to refund the one (of two) that you paid for0

No, but the criteria was that you bought 3 then you got them for £30 - by getting a refund you would no longer meet the criteria.
However, I think that a fair compromise would be a partial refund (i.e. £10 as suggested) or another item from the sale.0
