CCJ set aside, but not removed

We have checked my husband's credit report, which shows a CCJ, which was set aside, 8 weeks after it was registered, four years ago. He didn't realise that the CCJ had not been removed from the registers.

We have now written to the credit reference agencies with this information and have enclosed a copy of the court order.

When the notice of correction is added, will my husband's credit rating improve? He has no other debts or defaults against him.

We believe that this error will have had a severe impact on his ability to obtain credit and recognise that he should have checked his report. However, I am also annoyed that the solicitor dealing with the claim, at the time, did not register the set aside judgment.

    If set aside then the court should amend the register as a matter of course, which then updates on your credit reports. I would check with the court first of all to make sure they did that. If they did, then check with the registry trust to make sure they registered the removal and passed on that info to the CRAs.

    When you say 'set aside' did he have another court hearing or did he just pay and hence it was paid rather than set aside?

    I put in an N244 -and asked for the judgment to be set aside. The claimant wrote to the court, prior to the application hearing and concurred that it should have been set aside, both sides didn't attend. I have a copy of the court order, which is clear that the judgment was set aside. They were claiming for a judgment on a non secure loan, which was actually secured against his and his ex wife's property and therefore, subject to a possession claim , not a money claim.

    So either the court has made an error in not notifying the registry trust, or the registry trust has made an error, or the CRAs have made an error if the previous two did what they should. So you need to track down which of those is the case and get it sorted.

    the normal procedure is for the court to inform the rigestry trust. Once the registery trust has the ammended information, they forward this to the credit ref agencies. They then automatically ammend the details. This whole process is pretty quick . It shouldn't really take any longer than a week or week and half maximum.

    I had recently had my ccj removed from my account. The court informed the rgistery trust within 2 days. The registery trust took 1 day to inform the credit regesistry of the new details. I rang the credit ref agencies then to enquire what's their timescales in ammending the details. Equifax said once they recieved the info from reg trust, they would aim to have it done in 24- 48 hours (which was done). Experian, adviced me to wait a week for their records to update. But to my surprise it was done within 2 days of when the reg trust sent them the ammendments.
    It was immediately reflected on my credit report and i was able to acquire a high street credit card within the week of having the ccj removed!

    My advice to you is:
    a) ring the county court where your judgement was set aside and ask them if they have sent the info to registry trust.
    b) ring the registry trust and ask them to check out when they sent the ammendments of to the credit ref agencies. I did this and they were very helpful.- heres the number 020 7380 0133.

    As an update, my husband's CCJ has now been removed from the credit reference agencies and his credit rating has greatly improved. :T Thanks again for the help.
