Selling a property when no contact with joint borrower in years, please help

Hi,

I'll try to be brief, basically I purchased a property over 8 years ago with an ex, who left the property 4 years ago. Since then I have paid the mortgage etc alone & have had no contact from him bar an email about a year ago.

I now want to sell the property but have no idea how this can be achieved given I have no idea where he is. Can anyone advise on possible options for me please?

Happy to answer any questions if info is missing. Really do appreciate any advice. Thanks in advance.

  • There would be no equity in the property if that holds any relevance. Sorry couldn't effort original post on my phone.

You would still need his signature. We bought from a divorcing couple with the husband disappearing off to Amsterdam to explore his feminine side. What should have taken weeks took months. At the time we did read some legal way it could be forced, but were told it was really better to get him to sign when he was around and willing.
    Been away for a while.
  • Thanks for your reply, if I knew where he was, I'd hope he would sign, trouble is, I have no idea & no way of finding out :( as far as I know all his family have moved & I never where he went...

shouldn't be too difficult - try googling, finding mutual friend/aquintances on facebook or private detective?

Without his signature on the contract/Transfer document you will need a court order.

A solicitor will advise you how to obtain this, or, at a pinch, the Land registry migjt have a Guidance Note.

Could come back to bite you, it's not a joint borrower you're looking for, it's a joint owner.

You maybe already have, but you could try putting the email address he was using a year ago into social media sites and see if anything comes up.
  • Thanks for the replies. I've tried Facebook but we've no joint contacts now, his new GF made him cut all ties associated with me a long time ago. No hits on the email address either. I'll have a look on the land registry site.

    Thanks again
  • Court order for sale is where you may need to go.

I'd try a quick tracing service first of all perhaps. It's hard for people to genuinely disappear.
