Paid deposit for pushchair HELP

Hi,
First time posting so please be kind. I paid a deposit on a pushchair from an independent nursery store approx. 8 weeks ago. I paid 25% of the balance which is £165 this was paid on my credit card. I have since changed my mind on the pushchair I want and thought I could transfer the deposit as the pushchair I want is stocked at the same shop and is more expensive so the retailer would not be loosing out. I have however contacted the retailer and they have said that I cannot change my mind on the ordered item and if so I will loose my whole deposit. I just wondered where I stand on this as I obviously cant afford to loose £165 Thanks

From their point of view, they have ordered it in specially for you, and a small shop may not have a big demand for that item and may need to reduce it to sell it quickly.
Yes, they are legally in the right.
You wouldn't lose £165, you would lose 25% of £165 surely?0 -
I assume this was paid in a real store, and not online? If so then you will be in breach of contract if you pull out. They can charge you their losses, but they can't arbitrarily keep the whole deposit unless that is an accurate reflection of their losses. Obviously I have no idea what their losses are though so I can't tell you whether £165 is reasonable or not.0

The pushchair is likely to be more than £165 so I'm guessing this sum is the 25%.
Unless they've specifically ordered the item I think it's a little churlish of the shop to not allow the OP to swap to a different model. Whilst the law is on their side it's hardly good customer service.

I broadly agree with you fluffnutter, but I suspect this was ordered in specially, I'm also concerned whether the buyer got value for money. Did she shop around to compare prices? What attracted her to this particular shop? Small nursery retailers can't usually match the big shops on price.0

This is something op should have been concerned about before buying.0 -
You could probably breach the contract by telling them you are not completing the sale. You'd be liable for their losses - which I suspect would be a restocking fee and 2 lots of delivery costs. So say this £660 pushchair cost them £500, could well be £50-£75 knowing some retailers + about £16 postage (both ways) + a reasonable admin fee for their time. You could well be loosing anything from £100-£130. But still no reason you shouldn't get something back.0
