CarphoneWarehouse Dispute

I sent my phone away to carphone warehouse to be repaired under warranty. They have just called me to say that they are unable to repair my phone and they do not have any of the same phone to offer as a replacement. They have offered me a choice of 4 phones as a replacement but I'm not happy with them and I have been told that a refund is not an option.

Am I legally entitled to a refund on this?

    Why are you not happy with them? Where it goes from here depends on the answer to this.
    You might as well ask the Wizard of Oz to give you a big number as pay a Credit Referencing Agency for a so-called 'credit-score'

    Under the warranty, you get whatever is offered in the terms (usually a repair/replacement, but look in to the specific T&Cs in your case).

    If you are not happy with this, you can claim a remedy under the SoGA. As your phone is older than 6 months, you will need to get an independent report (you pay for this) to say the fault with your phone is inherent.

    If it is, CPW will refund the report costs and must then offer a repair, replacement or refund. As it seems they cannot repair or replace, they will refund. Please note that the refund can be discounted to reflect the 18 months use you've had (if there's an expected 3 year life of the phone, you may get a 50% refund for example)

    I have a Samsung Nexus S

    They're offering either
    1. Nokia Lumia 710
    2. HTC One V
    3. Sony Xperia Miro
    4. Sony Xperia U

    Which would you recommend?
