Just to mention, you do not 'now have 28 days'. You had 28 days to defend from the day of service of the claim form, not from now onwards.

I usually suggest someone with a new PE claim form reads back at least a dozen pages on that forum, clicking on and reading all PE court/claim/Northampton thread titles and reading the links & advice already shown. You should learn a lot from what's already been said and the cancellations achieved and court cases won/lost.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Bit of an update on this. I've just noticed the address where this alleged parking happened, and it's in an area that I rarely visit. My daughter works part-time in a Waitrose supermarket a few miles from us, and I regularly drop her off to work, but never use the car park there other than to do that. I've just asked my daughter about the possibility that I overstayed in the car park in December last year, and she has suggested that it was when she was going through the recruitment process, and would have had to attend the store to attend a recruitment event. If that's the case, I will be writing to Waitrose to ask whether it was unreasonable of me to park in their car park whilst waiting for my daughter to finish their recruitment event (my daughter doesn't drive).
Wish I hadn't binned the earlier correspondence now, but in any event, feeling slightly better about it0 -
Unfortunately for you, it is now too late to nominate your daughter as the driver in order to avoid Keeper Liability. Once court proceedings have started (which they have), keeper liability is the route they will be following. However, you'll need to check they have jumped through ALL the hoops that the Protection of Freedoms Act puts in their way. Their notices and timescales are almost certainly deficient.
If you've thrown all the correspondence away, you'll have to await their copies which, of course, you will demand from them as part of their evidence.0 -

Don't just write to them, go to the store and demand to see the store manager, not the duty manager taken away from the meat counter to pacify you.
Tell them that you were at the store on legitimate business, the outcome of that business your daughter is now one of their employees.
As a result, their agent, Parking Eye, are now taking you to court. Be very firm and assertive, loud, but polite. Don't take any BS about them not being able to interfere with PE, point out they are responsible for their agents actions.

Do you know if, with these big stores, the contract with the parking scumbags is agreed locally or nationally? That would probably make a difference as to whom I should raise my voice to0 -
Almost certainly locally (or possible regionally) Here in Sheffield Waitrose use Britannia Parking.0

Is it only Waitrose in the car park? It's just that they normally use Britannia (as in Brighton). If it's a retail park the complaint is for the Managing Agents.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thanks Dave. This is getting a bit complicated now - just spoke to the HR person at the waitrose store and apparently they don't use parking eye - they just have the old fashioned man walking about. PE do the Iceland car park, which is to all intents and purposes the same thing - just an extension of the waitrose car park. I had no idea there was a difference. Seems shouting at waitrose won't do the trick, and shouting at Iceland is likely to be non-productive as I wasn't even in their store!0
