Seller CASHED CHEQUE .... NOW NLRU

Paid for an item by cheque ... it has cleared from my account and on the same day seller has become a NO LONGER REGISTERED USER ... emailed several times to find out why & when I can expect delivery with NO RESPONSE .. tried to get details via ebay but it says this person did not register contact details .... ANYONE ANY IDEAS PLEASE !
Soolin .... Did I read a post of yours were you say a buyer of one of your items managed to claw back their payment even though it had shown as cleared several weeks later .... HOW did they do this as I would like to try the same as we are talking about well over £200 which I cannot afford to lose

While I dont want to go and find this person .....I WILL do so ....NO-ONE RIPS ME OFF and gets away with it .... its the PRINCIPLE !

Small claims court. You had a name and address to send the cheque to. It can only be paid into an account of that name.0

Yes I've had cheques clawed back when there was a problem with them, it has happened a few times and each time the reason for the clawback was different, so it might be worth a try. I wouldn't get too hopeful though as it seems the more honest you are the less likely you are to be able to work the system.
Is there any chance at all that you made a mistake on the cheque, a misreadable date or words that could be read two ways? If so talk to your bank and try and get the cheque recalled.
It might also be worth talking to your bank anyway and explaining that you have been the victim of fraud and can they help at all. Don't take their first answer though, bank clerks will also take the easy route (I know as I was one) so keep on at them, talk to senior bods, use the word fraud.
Ask for a copy of the cheque, if you are lucky it should be encoded with details of the payees bank. If you can find out the payees bank details talk to them as well. They will almost certainly not talk to you but it must be worth a try.
You have the mans name and address so send him an official letter giving him a set time frame to respond. The trading standards web site used to have examples of letters to use.

You could always open a dispute on the item problem is that some sellers seem to reach a certain level of neg feedback, are either removed as sellers and then re-register under a slightly different name.
I noticed this with 1 seller who we bought a bundle of clothes from they were new but they were realy bad quality after much hassle we got our money back but then he de-registerd leaving some people high and dry, when i was looking through the clothes bit again i noticed something familiar about a bundle listing and sure enough it was him back with slighly diff details!!!!

I don't understand how someone can buy or sell something and then become an unregistered user. Ive read on Ebay that you can't cancel your account until 6 months after your last transaction, so how do they do this?0

It is most likely the case that EBay NARUED the seller.

Ebay can cancel your account for any infringement, the cancellation is immediate and remains in place until the problem has been sorted.
As the seller in this case had incorrect or missing contact details that would be enough for an immediate NARU.
It is possible that it is a genuine mistake though and the seller might regain the account at some point, however, as a buyer I would always protect myself my trying to get my money back while ebay and the seller fight it out.
I don't buy from sellers unless I can use paypal, so my advice on dealing with a seller where the auction has been paid by cheque is third hand and based on my experiences as a seller. I'm hoping that other buyers who prefer to use cheques can offer coupon_king some better advice.

Like CookieMonster says It is always a good idea to open a dispute with ebay immediately a seller becomes NARU in case time limits apply. However going through the ebay dispute system rarely gets a good result so it is worth keep banging on at ebay over and over and not letting it drop.
cookiemonster..this seler is already NARU so copuon-king has very little leverage unfortunately.

contacted bank as you said they were quite helpful AFTER as you suggested not accepting their first theres nothing we can do answer ...after 25 mins pleading they have said if I file a fraud claim they are willing to trace whos bank account the payment was made they also informed me this persons bank will also investigate .... So fingers crossed !0 -

Well done coupon_king, it sounds like your perseverence might have helped you a little further on dealing with this.
I'd still be hopeful of getting your item but am worried because you are not getting any contact at all from the seller. It's certainly a good idea to start whatever you can do now to get your money back in case you have to.

OK Guys ... Things have progressed ... item arrived ...HOWEVER it is NOT what I was led to believe I was buying in fact it is half the size their listing claimed it was ..... they also quoted in the listing of a delivery of 1st class service ( which because of the weight of the item I thought I was getting... I didn`t mind )
AGAIN HOWEVER it has arrived 2nd class and because the weight of the item is half what it should have been ... it could easily have been sent by Royal Mail standard parcels ( £12.65 ) and NOT the £35 postage I was charged ...
So in a nutshell I have paid over £200 for an item that I know I can pick up for £125 ( brand new ) & been charged over £22 excessive postage as well
Please bear in mind when you give advice the seller is still NLRU and I paid for the item by cheque0
