getting out of tenancy agreement early

Hi guys


so im new to the site im desperately looking for help.


basically on the 28th November we moved into our new (nightmare) home.


since moving in we have had no end of "suprises" and to be honest are sick to the back teeth and want out!.


when we moved in we were told that we had two gardens one at the front deemed unusable by us as it has no suitable fencing and we are right on a very busy cross road and have a small child. so we were chuffed to be told that there is a reasonably sized piece of land out the back that hasn't been maintained but is our to improve if we want use of it. HAPPY DAYS! yet when speaking to the neighbour next dorr she say the reason why it has never been maintained is there is a dispute about the boarder/boundary and who it actually belongs to, there fore leaving us with out a "suitable" garden.


we also found out ONLY by setting up my payment with Welsh water that we have a septic tank on the property, now we don't mind this is works out cheaper than the WW sewage charge, but we weren't informed AND it wasn't emptied as per the contract by the previous tenant therefor they had to arrange to get this done (at no cost to us thank god).


Then some time in the last week "someone" has stolen our heating oil, when I rang to inform them they apologised but said this has happened before and it was sorted through the insurance and suggested this is what we did once we had informed the police. I havnt rang my insurance company yet but im scared they will know or I will have to tell them that this has happened before there for possibly making our insurance void.


when asked the following


"who's responsibility would it be to get a lock on the oil tank as at the moment it looks very much like it not possible to put a lock anywhere on it and we don’t want a repeat theft. and would it be ok to possibly put one security camera up that would cover the tank?"


I got this reply


"If you would like to put a lock on the oil tank, you are permitted to do so at your own expense. Our only advice is, if you do so, oil thief’s could possibly drill in to the tank to extract the oil and thus causing more damage. This damage would be your responsibility. You are permitted to erect a security camera so long as all works carried out to do so, are done to a professional standard, and if required at the end of your tenancy, it is removed and any damages to the property put right"


This has made me angry. I feel this is no win situation for us as I refuse to put oil in for it to be so easily stolen (ie no lock) but if I lock it and more damage to the tank occurs then im liable for much more expense. we have spoken to former tenants and to the landlady of the pub next door who have said oil theft is very common on this property and now I cannot sleep at night thinking someone is in our back yard.


I don't know where is stand with getting out of the agreement early as I
we have 5+ months left on the agreement and are liable to the end or until a new tenant is found plus a fee of £210 if we leave before the end of the tenancy


please help phoning CAB early next week as only open Mon and Wed in our area.

  • I did until I felt unsafe in it. id like to pick up the house and take it somewhere else and with a different agency who are upfront. my partner hasn't liked it since we moved in and iv been fighting its corner but the bad now far out ways the good and im gutted :(

    Well The septic tank you said you don't mind as it works out cheaper than the water charges. The other issue can be solved , I don't know how but someone will be along with suggestions.

    If these two issues are the only things, and everything else is great why don't you give it a go and try to make it good.

    If you can't , 6 months is not really that long , by the time you unpack properly you will need to start packing again :)
  • But in 5 months time I will be 8 months pregnant and wpuld really like to be settled before baby arrives it was a main factor in moving home in the first place. Im also not getting sleep at night every noise I think is someone on our property.
  • If you've got a baby on the way and want to settle down...well, you shouldn't be a renter. Sorry to sound harsh, but that's the reality of it. Buy a property if you want a secure home.

    The LL or agent isn't obliged to tell you the crime rate in the area, nor is he responsible for it. If this was a concern to you, and you'd asked questions such as 'has the property suffered recent theft or damage?', then he would have had to give you an honest answer and not misrepresent the property. But you didn't ask. Caveat emptor.
    I'm not clear how you think CAB can help you get out of a lease that you freely entered into, without penalty?
    No free lunch, and no free laptop ;)

    Flood lights and camera may well do the trick.

    Doesn't matter who puts these up as long as u remove them when u leave. Ignore the professional standards bit

    If you've got a baby on the way and want to settle down...well, you shouldn't be a renter. Sorry to sound harsh, but that's the reality of it. Buy a property if you want a secure home.

    Silly and unnecessary statement. Not everyone has a deposit for a house lying around
