Hi
Hope you can help. My parents ordered a suite and took out a credit agreement for the balance. Paid deposit with credit card. Company has since gone into administration so they will not be taking delivery of goods. They claimed back deposit from credit card co with no problems but are having problems cancelling credit agreement as they are saying they have no evidence that they wont be getting the goods. Parents have sent copies of all documents from administrators but are getting nowhere. They are worried how this will affect credit score and if company will try to take out payment from bank even though they haven't taken delivery of goods
Any advice is appreciated.

The whole point of administration is to protect the company so that it can hopefully continue to trade or the business can be sold as a going concern.
Of course it doesn't always work out like that.
The mere fact that the company is in administration is not in itself proof that the goods will not be supplied.
Do you have any proof that the goods will not be supplied?
Perhaps a letter from the company saying that?
If you do have proof then send it to the credit company.
If you don't have proof, maybe seek the necessary proof from the administrators.
Perhaps MSE's Administration Help article is worth reading.0 -
Administrators have confirmed in writing that goods will not be sent. This document has been forwarded to credit company. So proof has been sent already problem is credit co are not accepting this.
I have already confirmed this has been sent to credit co in my original post0 -

Then all you need to do is ask the credit provider what further proof they need.I have already confirmed this has been sent to credit co in my original post

Nowhere did you indicate that that documentation included a statement that the company were not going to deliver the goods.
Oh yes they have!Administrators have confirmed in writing that goods will not be sent. This document has been forwarded to credit company.
Or did you miss that bit?0 -
Not in the original post they didn't. That info was provided later, AFTER comments were made.

What reasons/excuses are the credit company using to not cancel the contract?
Was the finance arranged by the retailer at time of sale or was it a separate loan your parents organised themselves? You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride0
