Harassment by HSBC - Please help me?

  • I have a copy of a harrassment letter from the CCCS if that would be of help and they also told me to refer the matter to my local trading standards office who were reluctant to help at first BUT once I explained the impact on my day to day life they were happy to help (which incidently wasn't as much harassment as you are getting) it is bang out of order you are not liable and I would be tempted to say to them to take you to court then you can have it out in front of a judge (or whatever they have in County court) there seems to be no getting through at times. I really feel for you it must be awful don't let it lie though I had a similar thing happen to me with GE Capital bank an £11 balance turned into a £287 balance I got so worn down got depressed and the vultures got a CCJ against something I have never been able to rectify because I don't know how.

    Whatever you do, don't let the complaint drop. The CAB sounds a great idea as the Bank don't seem to be listening, and the CAB have the contacts to kick a*s, can offer you the right guidance, and most importantly, support.
    Depending on the outcome of the CAB, if you are still not happy, go via the FO. It is free, the form is relatively simple, although you do have to be very concise. It sounds like you have a very strong case, and you have everything to gain and nothing to lose.

    One other thing that might be worth doing is copying the demand and sending it to whoever sent the holding letter and vice verca, and attach a brief note telling them that this conduct is unacceptable as you are still awaiting a final reply, and if not satisfied, the matter will be referred to the FO. It will be proof that you have replied to the demand, and will let the Senior Investigator know that you won't be fobbed off.

    It sounds as if the left hand of HSBC doesn't know what the right hand of HSBC is doing and you have received a (automated?) letter because of this.

    I would simply reply back saying your case is being investigated by HSBC Complaints/Senior Investigation etc and ask them to cease any action in the meantime.

    I would also contact the HSBC complaints dept (whoever is dealing with your case if you know) and tell them you have received this letter and ask that they ensure that any 'collection' activity is suspended until the outcome of the complaint process.

    I would not pay and settle regardless.

    Depending on the outcome of the HSBC complaint, don't forget you can go to the Financial Ombudsman if you're not happy with the result.

    Thanks everyone for all your help. I have sent the harassment letter, they replied when they "investigated" at the first level and said that they noted that I only wanted contact in writing, but that my phone number was being rung by an "automatic dialler" which would continue to ring me until the matter was sorted. Talk about left hands and right hands, I have been getting calls now for months and it just wore me down so much I had to stop answering them, as the guy who was calling just didn't understand what I was trying to tell him. I guess this department is the one who has issued the letter.

    If I send copies of the letter to the Senior Investigator to this mysterious "Centre Manager" and a copy of his letter to the "Senior Investigator" then do you think this will be enough to get them to "hold" the further action? Trouble is I'm just getting very nervous of them doing what they say they will do and inforrming Credit Reference Agencies, I don't want that to happen, I've never had a bad thing for anyone to put on me before despite being in a mess financially for years since I got divorced. I am thinking I might try moving house soon in an effort to make serious life changes and would need a new mortgage. Help!

    I haven't been to the Ombudsman yet as I thought I needed to exhaust their complaints procedure and that is currently at Stage 4 of a 3-stage process. But they have told me to write to this Senior Person which I have done, and who has acknowledged my letter and said that they are carrying out a full investigation into the matter...

    Hi again,

    If you want to check what this has done to your credit rating/file then have a look at your credit report you can have a look for free if you sign into a plan but you should cancel before 30 days to avoid being charged there is experian and equifax being the main ones there is also I think call credit all of these will post you a copy of your file for a statutory fee of £2 then if HSBC have done anything to it you can also tell them to get that sorted.

    As for the ombudsman I think you possibly can run both at the same time and if so then I would consider doing it it may well mean that HSBC take you a bit more seriously.

    I rang the Ombudsman today, they were very nice on the phone, sounded very fed up with what HSBC have done, and they are going to write to HSBC today to say they are now investigating. I have had to photocopy all of the letters and they are sending me a form to fill in.. I am still scared, but not quite so much now...

    If you have an HSBC chequebook for the account which is in dispute, I would write them a cheque for the outstanding amount owing. and pop a cheque like this in with each complaint you send off. That should make these idiots sit up and take notice.
