    I've no idea why you posted on this site at all if you trust CAG to sort this out for you. They'll just tell you to take the Bank to court and (having lit the blue touch paper) they will retire to watch the fireworks when you fail.

    And then moan about how unfair it all is that the banks won AGAIN.

    The approach the OP quoted is a novel one, I'll give them credit. It's still not right - BCOBS says nothing about the application or level of charges, the only way OP got that is to interpret "fair" as meaning "doesn't set charges at a level I don't like". It also says that due support should be given to people in difficulty, but "fairness" and support to those in hardship does not have to involve refunding charges - it can involve a whole number of things, but it requires co-operation and pro activity on the part of the customer. If the only solution the customer wants is all their charges back, and they don't agree to anything else, neither the bank nor FOS are likely to deem that to be a failing with the bank.

    Depressingly though, the legal threats might work. Possibly not, since Clydesdale are known to be more difficult about charge refunds than other banks. If they don't and OP takes them to court, they will most likely lose and be out far more than £375.

  • I left it over the festive period and I didn't want to let things get heated here. I appreciate everyone's views and opinions and I apologise if I came across as being stubborn and with an attitude, it was not intentional.

    As I am in receipt of Income Related ESA I am entitled to an exemption of the small claims fee at Glasgow Sheriff Court.

    I still intend to pursue Clydesdale Bank for the amount I've requested as their offer of £50 as a gogw is an insult. I contacted the CEO by letter (kept it really polite) asking him to look at the decision made by the bank and possibly reconsider and I have had no response, which doesn't surprise me.

    I think I've been reasonable with Clydesdale and given them every opportunity to resolve this without the need for either of us to go to court. I intend to use the information I have collectively gained, not just from MSE, but from CAG & Govan Law Centre to complete a Statement of Claim and submit this to Glasgow Sheriff Court first thing on Monday morning.
    What a load of dunderheids!
